German Product Safety and Compliance Requirements

I had a phone call from German Seller Performance team earlier today saying that I need to upload product safety images for all of my products otherwise they may soon be suspended from Amazon.de

The lady told me where to upload these, in the Catalogue / Upload Images / Image Manager, and said that these need to show the front, side, back of my products and show any safety labels product warnings and markings.

None of my products require a CE mark, use batteries or need and safety documentation.

Do I just take photos of all of my packed products from the sides required and upload them?

I asked if this was just for Germany and she said it was applicable across the whole of the EU.

Does anyone know anything about this?

Many thanks, Damian

This is the email I got relating to this:

Dear Seller,

Thank you for talking to us about your Amazon seller account.

Why did I receive this message?
As a seller, you are responsible for ensuring that the products you supply and your online listings comply with all applicable laws. If you offer a product online, you must provide and display the required product safety labelling information, warnings and markings on the product detail page.
In addition, an EU regulation on product safety called the “Regulation on Market Surveillance and Conformity of Products” came into force on 16 July 2021. This regulation requires a person to be present in the European Union to act as a contact person for product conformity (a “responsible person”) for products bearing the CE marking. The EU is expected to introduce a new regulation called the General Product Safety Regulation (GPSR) in 2024. This is likely to introduce responsible person requirements for all products sold in the EU.
For more information, see Product safety and compliance, Responsible person requirements for CE marked products and Responsible person requirements.

What measures do I need to take?
It is now possible to upload images showing product safety labels, warnings and markings in Seller Central under the image variant on “Product Safety and Conformity”. The information should be provided in the form of six images showing all sides of the packaging together with product safety labels, warnings and markings.
The requirements for offering your products may vary depending on the product and the country in which you sell. We therefore recommend that you consult your legal advisor and/or supplier to ensure that you have all the relevant information.
At the same time, Amazon provides a dashboard in Seller Central that allows you to specify the responsible person in the EU for your brand, ASINs or listings for the requirements of the Market Surveillance Regulation (EU) 2019/1020 and helps you prepare for compliance with the upcoming General Product Safety Regulation. In addition to ASINs with shipping through Amazon (FBA) sold by sellers outside the EU, responsible person information can now be added for all other ASINs with CE marking offered in our EU shops in preparation for the GPSR. Newly added ASINs will be displayed with a due date of 30 September 2024.
If you are the brand owner of CE marked products, you can designate a responsible person in the EU for your products. If you are a reseller of CE marked products and you do not own a brand, we recommend that you contact your manufacturer or upstream supplier so that they can provide you with the contact details of the responsible person(s) for the products you offer.

How do I send the requested information?
To upload images under the “Product Safety and Compliance” variant, follow one of the steps on the “Add Product Images” help page https://sellercentral-europe.amazon.com/gp/help/external/200216080?ref=PSI_email_PSIHow.
To upload the responsible person information, follow the steps on the “Responsible person” help page https://sellercentral-europe.amazon.com/help/hub/reference/GSDP2QRYVQ5SUFLE.

What happens if you do nothing?
We may remove listings if we find that the required product safety information is missing.

I’ve just looked on my Account Health Dashboard and there are no product compliance requests.

I don’t understand why I’ve got this, and what I need to do.
