UK based company selling on Amazon USA

Hi,

I’m a UK-based seller. Company is registered in the UK. If I want to move stock into America to start selling on Amazon USA, are there any additional requirements? E.g. Do I need to have a US-based company or anything of the sort?

Marsh Commercial can help with the US Product Liability Insurance through Amazon’s links on the Insurance page on Seller Central USA, they are an Amazon accelarator. The difference is in the USA that you need to have Amazon named on the insurance policy, which no normal insurers will agree to.

You would be operating as a foreign overseas entity. Sales tax is handled by Amazon for all bar 3 states, including New Hampshire and Delaware, that have not signed up to the agreement that the others did. If there is no Amazon FCs in those sites you may not have Nexus, which is the mechanism requiring you to register in a state. Every State has different rules, USA is like 50 countries.

You would have to register at Federal level with the IRS as a foreign entity but no tax is due under the dual taxation treaty between the USA and UK. A CPA would be needed to file your US Federal Tax return.

Personally, I wouldn’t sell in the US from the UK using the Amazon platform. Or certainly not unless you have enormous margins. This article explains why (not written recently or for Amazon sellers but the points remain).
