Subject: Appeal Against Account Suspension - Due to Product Authenticity Complaint

Dear Amazon Support Team,

I am writing regarding the suspension of my account due to a complaint related to product authenticity. I would like to emphasize that all our products are completely genuine. It is likely that this complaint was made by a brand owner in the Canadian market to eliminate competition, which we find unfair.

We operate a dropshipping business fully in compliance with Amazon policies. We source our products from Amazon US and sell them in Canada. Upon reviewing the invoice for the disputed product, it becomes clear that this item was purchased directly from the brand owner who filed the complaint. In other words, we obtained the product from the original manufacturer who is now making this claim.

We have only sold one unit of this product before, and there were no complaints regarding its authenticity from the customer. The item was shipped from the Amazon FBA warehouse, where it underwent all necessary checks, making it impossible for it to be counterfeit. Despite this, the brand owner has filed two complaints against us. In response to the first complaint, we successfully proved the authenticity of the product, and our account was reinstated.

We have submitted additional detailed documentation regarding this issue, including the relevant invoice and supplier information. However, despite numerous appeals, our case has been rejected. If we are being accused of selling counterfeit products, we believe the brand owner, who directly supplied us with the product, should also be held accountable.

This situation has caused us significant harm, and we believe the brand owner's actions are aimed at eliminating competition. We kindly request that you review this matter and reactivate our account as soon as possible.

Thank you for your understanding and cooperation.

Sincerely

Hello @Seller_NdjFKalywUXIM,

Thank you for posting your concerns with your account deactivation.

I am writing regarding the suspension of my account due to a complaint related to product authenticity. I would like to emphasize that all our products are completely genuine. It is likely that this complaint was made by a brand owner in the Canadian market to eliminate competition, which we find unfair.

Upon reviewing the invoice for the disputed product, it becomes clear that this item was purchased directly from the brand owner who filed the complaint. In other words, we obtained the product from the original manufacturer who is now making this claim.

As noted you are dropshipping and sourcing from amazon. Sourcing products this way can be a direct violation of our responsible sourcing requirements, supply chain standards and intellectual property policies. Amazon is considered retail and is not an authorized distributor for resale. We sell to end consumers unless you're taking part in our business to business sales.

Sourcing documentation from amazon is a receipt and does not validate a full supply chain nor does it authorize you to resell them on amazon, or in another region of amazon. Even if you sourced them from this company on amazon, you need their authorization to list and sell them on amazon or risk infringing on their intellectual property rights.

You may be required to provide a letter of authorization or invoices from an approved and valid supply chain that is not on amazon as we may not accept them. I would ask that you pose your original deactivation notice so I can offer more specific guidance on your situation.

This situation has caused us significant harm, and we believe the brand owner's actions are aimed at eliminating competition. We kindly request that you review this matter and reactivate our account as soon as possible.

If we cannot validate compliance with these policies the account will not be eligible for reactivation.

The forums community and I are here to support you. Please let us know how we can help you from this point forward.

No, you don't:

We source our products from Amazon US and sell them in Canada.

That isn't dropshipping. It's online arbitrage, you're using an online retailer to source your product which is a Big NO NO and you do not have a valid supply chain.

Upon reviewing the invoice for the disputed product, it becomes clear that this item was purchased directly from the brand owner who filed the complaint.

Are you authorized in writing by the brand owner to use an online retailer to resell for your business?

The item was shipped from the Amazon FBA warehouse, where it underwent all necessary checks,

So, not dropshipping at all then. Why do you think you're doing dropshipping? This isn't dropshipping!

Hello @Seller_NdjFKalywUXIM,

Thank you for following up on the situation.

You have informed us that we have violated intellectual property rights. We acknowledge that this may have occurred, and we accept responsibility for it. However, since we operate a dropshipping business, it is not feasible for us to verify each brand individually.

This is a concern of authenticity and proper sourcing, not intellectual properties. If this was an intellectual property violation or complaint you would be advised on the complaint ID or related trademark number, and in some situations the brand or rights owner email address.

Regardless of you having a "dropshipping business", you are individually responsible for the verification and compliance of ALL products and listings in your manage inventory. This includes verifying you are sourcing from an authorized distributor, received approval from the brand or rights owner to list and sell their products on amazon. If you are not conducting these reviews you may not be sourcing from an appropriate supply chain causing concerns.

If we have indeed violated any intellectual property rights, we are unclear as to why the brand has filed an authenticity complaint. We have sold genuine products and have never even considered selling counterfeit goods. I have been selling on Amazon for two years, and I am well aware that selling counterfeit products is prohibited. Knowing this, I would never engage in such behavior.

We believe the brand has made an unfair complaint, and we kindly request your assistance in resolving this matter.

We source our products from Amazon US and sell them in Canada.

As previously stated, this is not coming from a brand but a general complaint of authenticity which can stem from buyers or amazon concerns, account and or selling history. We at this stage need to 100% verify that your product is authentic and that you properly source it from an authorized and approved supplier. This will include valid invoices from the authorized supplier, along with a letter of authorization confirming your authorization to list and sell these products issued by the brand or rights owner. Without this confirmation the account will remain deactivated as this is the only path forward at this time. Due to the nature of the described sourcing path, and this not being an authorized or approved source of any product, the account may not be eligible for reactivation at this time.
