Checking for brand names

Hi Everyone,

Im looking at registering a trademark to start my own brand, never gone down this path before.

I can find that you can apply on the government website for £170 , but I have a couple of questions if someone can help please :

1) Does anyone know where you can check to see if the trademark as been registered ?

2) Also as it says it take approx 3 - 4 months to register, can I still have the products manufactured and sold on Amazon under brand name while waiting approval ?

3) Am i right in thinking, once goods are made and the name and logo is on the product, this is all what would be needed to create and get approval for the listing on amazon and start selling them and trademark when approved and in place would give me the ability to stop other sellers using brand name and listing against my asin ?

2. You can - but if the IPO do not approve your trademark then you have wasted money applying it to products and packaging.

3. No, you also have to apply for Amazon Brand Registry. But as other threads on here show, that does not stop sellers listing against your ASIN

when searching on the trademark search leave it set to 'similar' so you can see similar trademarks, i tried to trademark a completely made up word and it was too similar to some company in america who objected and i lost my money:( good luck with it!

Check on the IPO - it's the bible for trademarks.

Do your search in every which way, if there is something similar it will be shown - if it's not on there then it doesn't exist.

Yes it's £170 - you apply and they give it a once over glance, if the IPO decide to get things rolling then fine, if they don't, the £170 is lost.

Stick to their guidelines on wording and images - if you don't you will be declined without redress.

Once they in principle rubber stamp it it goes through a 2-3 month period for anyone else to object to it - if this happens then you'll have some stuff to sort/alter your application. If not, it gets published and rubber stamped and away you go

Remember, this is only a trademark and not a patent - your name is protected but not the actual product.

Then you have the arguments to follow with Amazon and it's bots, that'll make the first 3 months with the IPO look easy as pie,

If it's you own brand going on a generic product then you really need your own barcode and ASIN otherwise as mentioned by others your listing will be piggybacked.
