Amazon Brand Registry Question - Controlling The Price

Hi all,

Were thinking of registering a brand that we own through amazon brand registry. More for the reason to try and control the price our products are being sold at…

Is this possible at all? Say for instance we currently have amazon pages set up for the products we sell and customers are listing way below the recommended retail price of the product so we want to stop that and just set the price ourselves? is this possible through amazon brand registry?

I would imagine not but if you did, it would probably be followed by a quick visit to the Crown Court to attend an anti-competition case against you for price fixing. :policeman::oncoming_police_car:

Even with Brand Registry you cannot control the price element through Amazon, if the other Sellers are buying the product legitimately, you can use Brand Registry to block sellers who illegitmately sell your product or sell unbranded equivalent products, but this is still difficult to police through Amazon. It’s actually against EU Competition rules to effectively control pricing.

I would assume that if you set up brand registration and thereafter set up an “enhanced brand content” page for your product then only you would be able to sell against that specific listing.

Whilst that doesn’t fully solve the problem it would mean that other sellers would have to setup a separate listing using a different ASIN etc.

Another thing you could do is also claim IP rights on your product photos if other sellers come along and use them without your consent. Therefore other sellers would have to create their own images and hence making things a little more difficult to compete with you.

On another point if you are selling your product say at £19.99 then someone else comes along and buys from you and sells for £4.99 - there are obviously making a loss! I’m I correct in assuming that you are also selling at a lower price i.e. wholesale and if so I would get those customers to agree not to sell on Amazon as part of terms and conditions otherwise maybe stop selling at wholesale.

Finally as I’m no legal expert you probably should get this investigated as well as confirming with Amazon whether my assumption that “Enhanced Brand Content” pages are exclusively for the brand owner.

No even with Brand Registry that we have on certain lines, this does not stop other sellers from listing against that ASIN, you can raise a case to have them removed but if they can prove they have purchased the product legitimately they will not be removed. This is particularly a problem where a manufacturer is selling products globally or PAN EU that the UK, for example, distributor has sole distribution rights for but is unaware other distributors and resellers may be buying the product legitimately and as Amazon is an open market place are able to then compete within a local market. Amazon does not police that arrangement it wll only check the validity of the sellers products.

You also do not own the ASIN/Listing this is a catalogue listing created in Amazons marketplace.
