FAKE TRADEMARK REGISTER

Hi Everyone,

I’m sure others have experienced a similar issue, and I’d like to know how you handled it. I recently received an "Intellectual Property Complaints" notice. After researching and contacting the manufacturer in the USA, they confirmed that the entity registered under the UK trademark is not an authorized seller.

I reported this issue to Amazon, including a screenshot of the manufacturer's respond email, but Amazon has done NOTHING so far.

Has anyone else faced this, and what steps did you take to resolve it?

Hello Dear Julia, We got an fraudulent Parallel Import violation on 26-Sep-2024. Details Below;Rights owner communication: UNAUTHORIZED SELLER

Infringement type: Parallel Import

Complaint ID: 10341409602

The trademark itself is a fraudulent application. If you check the address on the UK UPO website, it shows up as a Pakistani or Indian person [Moderator Edit Sarah_Amzn: personal data removed] which is not a business and just an individual who not owns the trademark registered with the word very similar to the brand itself. The ASIN itself have different brand name than the registered word mark. Also the person (public info) who owned 5+ other dissolved UK Ltd companies, all classified as "Retail sale via mail order houses or via Internet" businesses. I am pretty sure all the other companies have or had Amazon Seller accounts which were suspended/banned, or simply exist to illegally evade HMRC VAT (keep annual turnover below 90,000 GBP and switch owner of Amazon account to the new LTD)

I can go on about the illegal and fraudulent behaviour of such sellers. This IP claim is one of those. Sellers such as these find small US based companies who are not active in the UK and fraudulently file for IP to the UK (fake ownership documents + 120 GBP filing fee), so they can sell the products on amazon.co.uk exclusively. There are "courses" being sold by "amazon gurus" that show them step by step how to do this. This is also how I know such an organized crime gang exists.

Such US companies do not even have any idea about having UK trademarks.

On the other hand. I have found that the correct brand owner company have a valid trademark application in 2024 in Examination status with the exact brand name.

We also contact with the real brand owner and they said that they do not know about the registrar of the UK fraudulent Trademark. They also shared all their authorized companies in UK. [Moderator Edit Sarah_Amzn: personal data removed] not in the list as we expected.

**Another important point that; How can be possible to system allows to file an Parallel import IP Claim for the USA based brand even the fraudulent trademark word is different ?

** We also tried 4 times to contact with the email information in Policy Warning which is not a commercial email address (free email service gmail) But no one responded our emails at all.

This is a serious issue that is hurting our account. If you look at the UK trademark holder, it is yet again an Pakistani/Indian individual. And the account that is exclusively selling this item. No brand owner would give such an amazon account exclusive rights, let alone letting them hold the trademark to their brand.

Amazon needs to take this issue seriously, as these cases are going to increase -because these "gurus" are selling "courses" showing them the way.

Let me know if you need any further details on this issue. It will hurt resellers like us as long as these types of mischievous and fraudulent people are allowed to carry out their actions on Amazon.
