Despite having identical information and design, my brand registration is being rejected.

Hello everyone,

I've applied for a trademark three times now, and each time it has been rejected. The reason for rejection is as follows: 'The brand name on your product images does not match the brand on the brand application. Please ensure the trademark name is clearly visible on your product images.'The name of my brand is Saf Diamond Handmade Jewelry, and this logo is also present on the top of my product boxes. In the logo, only the Saf Diamond part is handwritten, while Handmade Jewelry is in standard font. In the country where I am registered, I have a trademark application with the same name and logo, and I have provided those documents as well, but I have not received any positive response.

I'm wondering where exactly I'm making a mistake.

The pictures look good but all that is missing is your registered trademark. I need to confirm that its active and where it is.

I suspect two things.

1. You are not selecting the correct trademark office associated with your brand. You have to select TPTO.

2. The brand registry team is rejecting your application because your trademark is all lower case.

Your brand name = Saf Diamond HANDMADE Jewelry

Your trademark = saf diamond handmade jewelry

If you are selecting the correct trademark office, I would suggest making a new logo just for this purpose. Have it all be lower case letters and print it on one box so brand registry can approve you. Once brand registry approves you, you can use your original logo.

I suspect the issue may be that the font is different (every uppercase and lowercase letter must match what the TM says), and secondly, your product images should have your TM name too.

I'm a little confused on your post, if it is Amazon or the actual TM office denying it. When I filed my TM I had to show my TM name as I had it registered and include sample photos of my products with the TM Name ON the product.

Is your trademark application a word mark or a design mark? If you applied for a design trademark, then your logo has to match your design in the trademark application EXACTLY. If you applied for a word mark for the words saf diamond, etc., then your trademark would cover any design you made for your logo. This is why companies often file applications for a word mark and a design mark - to protect the words no matter how they are presented, and to protect the current design of a logo or branding. If your application is for the words, then Amazon can't reject your brand registry.

The case has to match exactly or Amazon will reject it. This is why Chinese brands make-up brand names that are a random collection of capital letters so there is no possibility of confusion. DFDSLF MFPOO OEMNLGF etc.

If your trademark submission was all lower case or all upper case or mixed case, that is what your Brand Registry application has to match.

If your trademark is for a wordmark, the logo won't matter.

I do see that you just reapplied! As you hear more, please keep me updated.

However, I do see on your prior application that you attached a "Generic" ASIN in the "Suggested ASIN" field which is what I believe to be the cause of the rejections! Glad to see you left that out in your recent application.

Your logo and packaging are beautiful!

If they insist on something that their bots can read, consider wrapping a paper sleeve around the box with both your logo and a clear plain font easy enough for the Bots or OCR's to read.
