Recurring problem reporting intellectual property infringement - Need help?

Hello everyone,

I’m currently facing a rather frustrating problem on the Amazon platform, and I’d like to share my experience with you. This is the second time that a competitor selling a product similar to mine has reported me for intellectual property infringement. According to him, my product is too similar to his. Each time, Amazon took action by blocking my ads.

The first time, Amazon simply removed the images associated with my offer, which was a blow to my business, but I accepted it. This time, however, they removed my offer completely, which has an even greater impact on my business.

I understand the importance of protecting intellectual property, and I fully respect the rights of other vendors. However, I am convinced that my product in no way infringes this competitor’s intellectual property. There are significant differences in the features, quality and design of our respective products. Unfortunately, my efforts to prove this to Amazon have not yet been successful.

So I’m asking for your help and advice. If you have ever been confronted with a similar situation or if you have any specific knowledge regarding Amazon’s intellectual property policies, I would be very grateful for your advice in solving this problem.

IP law basically comes down to two things, 1) Passing off, and 2) Is there chance of confusion ? . Pretty much everyone understands passing off, but point 2 is more contentious - ie would a consumer purchasing your item have reason to believe that, whilst it’s different to the other item in question, the same Company could have produced both. In this instance, someone could be benefitting from a larger entities brand equity and longeivity for example. On planet earth, if you can prove that neither of those things are infringed upon, you should be in a decent position. Dealing with IP issues on this platform however seems not to involve humans, like most things, and could be much more difficult.
