Complaint regarding suspected counterfeit product.

hi guys I’m wondering if anybody could please please help me, I’ve been on a listing for about 6 months now. The product is a Chinese product, the listing I went onto was not branded at all our products were literally identical. She then started to drop her price a penny to undercut me as I had the buy box as I was fba her fbm, she carried this on and then became an fba seller and then I received a product complaint to say I was suspected of selling a counterfeit item. I have challenged this with everything I have. Amazon have removed the item and currently have over £3000 in stock of this product (this is what it would be once it sold) I’ve sent invoices from the supplier, payment proof etc, anything they have asked I have sent and they’re still saying they cannot verify the supplier. Please could somebody help with where I am going wrong or at least how I get the stock back to set up my own private label listing? It was a great seller and I know myself and the other seller get from the same supplier but I just don’t know where I am going wrong?

You went wrong if you listed a product on a listing that although not branded, did actually have a brand. On the ASIN in question, under the title, there should be a hyperlinked brand. What did it say?

If it wasn't Generic (though even the rules on that have just changed) then you were incorrect to list on the listing. Essentially, you can't prove the products you have aren't counterfeit - as they aren't the brand amazon have logged for the ASIN.

......at least how I get the stock back

I believe you would have to create a removal order, BUT I am not sure if that is possible if it is suspected counterfeit, as i don't use FBA. Hopefully someone else who does do FBA can advise correctly.

In order to reactivate your listings, I advise you to adhere closely to the following guidelines when uploading your invoices.

Just so you know, Amazon takes "inauthentic" complaints seriously and selling counterfeit products is a big no-no.

There can be many reasons for the rejection of the invoices, please check with your supplier whether he is authorized with brand or not. Ensure that the invoices are matching the below criteria:

  • Copies of invoices or receipts from your supplier issued in the last 365 days for the ASIN/s flagged.
  • These documents should reflect your sales volume during the last 365 days.
  • Please include contact information for your supplier, including name, phone number, address, and website. Amazon will maintain the confidentiality of your supplier contact information.
  • You may remove pricing information, but the rest of the document must be visible. For ease of review, you may highlight or circle the ASIN(s) under review.
  • You can only send .pdf, .jpg, .png, or .gif files.
  • These documents must be authentic and unaltered.

NOTE: Please ensure that the documents that you are submitting are clear and not blurry.

If you want to learn more about Amazon's policies on the sale of counterfeit items, you can refer to the following Seller Central help pages:

Amazon Anti-Counterfeiting Policy

Policies and Agreements

If you need any further assistance, you can post here so that we can help you.
