Trademark misuse(Coca-Cola) - Not even coca-cola mentioned or implied - how do I address this ?

Hi Everyone,

Hopefully someone can help. I have 3 violations for 3 asins for cola lollies. Trademark misuse(Coca-Cola)

Now 1st thing I did was on the 1st or 2nd of August went to Amazon help - opened a case and sent them an email explaining that they are cola lollies and not coca-cola lollies. Neither the trademark is mentioned or any images of coca-cola - because put simply, they have nothing to do with coca-cola.

Obv's a bot as picked up on cola, now ive come back off holiday to find that my email is not even in my case log, I knew i hadn't had a response because of course checking messages every day.

Does anyone know how to address this ? I have read you can just edit page and remove trademark - but the trademark is not mentioned anywhere and no image implies the trademark.

I have thought about removing the word cola ( even though I shouldnt have to ) - because the listings are assorted lollies. 1 asin for example is 100 x Chupa Chups Lollipops (12g Each Standard size) Mixed Flavours Including Cola, Apple, Strawberry and Strawberry and Cream ( I COULD SIMPLY CHANGE THIS TO ASSORTED FLAVOURS )

But when i try to edit the listing, I get an error ( Product Detail Page Rules Violation (Inaccurate information on product detail page) https://sellercentral.amazon.com/gp/help/G200390640 )

But the bullet point just simply states - Mixed bag of 100 chupa chups, ideal for party bag fillers and pinata prizes next to the erroe code

And whatever I change it to, still comes with the red error message

This is happening on all 3 asins.

Biggest worry is, I have other cola lolly listing for all cola and worried that if the bot picks up on more of them, could lose my account.

Any help on moving this forward would be really grateful ( Amazon of course - are no help whatsoever again on a simple bot mistake )

Hey! If you get any joy please let us know!! We have had about 20 listings turned off so far, all just sweets that are cola flavoured! Cola bottles, cola cubes, fizzy cola bottles, you get the picture! As you say even things that are assorted flavours that list cola as one of the flavours! Using the word cola to describe a flavour is not a trade mark mis use!!

I think the issue is with the following trademark registered by Coca Cola.

UK00001564828

They are trademarking Cola logo on a black and red background but the registration very clearly states

Disclaimer

Registration of these marks shall give no right to the exclusive use of the word "Cola".

I suspect the bots are not clever enough to see the disclaimer and just see that Cola is registered to Coca Cola and then issue violations to anyone using the word Cola.

I would appeal stating that the relevant trademark states 'Disclaimer Registration of these marks shall give no right to the exclusive use of the word "Cola". and that the listing has been removed in error

I had a similar issue, where I was selling Cola Bottles, as in the sweets! I contacted Amazons 'Account Health Assurance' team, and they said to appeal and they would remove the Trademark misuse as it clearly isn't a Trademark misuse. I think these big corps may be using AI to scrap the internet to file Trademark misuse. But its not very good.
