Competitor Keeps Buying All Stock And Returning Damaged!

Hello.

I have had a competitor order all my stock, left negative feedback and returning stock damaged by ripping them apart. He did this on a few orders and ordered almost 200 items. when i clocked it. I noticed his buyer shipping address was the same as the other sellers address on Amazon. I managed to get the feedback removed and limited to 1 per buyer but he has continued to order 1 at a time over 100 times and since ordered 115 different times ordering close to 300 items

Obviously this is costing me a fortune in FBA fees and not to mention the removal or disposal costs and shipping them to Amazon.

He has succeed in stopping me selling the product.

I tried reporting this but it never gets nowhere. I can’t even block the buyer.

What is the item, ASIN ?

Question? - was it their listing first and the item is a so-called generic item?

So let us give an example:

The item is made in China by Acme Factory, called T-Shirt 22.

The listing says ‘XYZ Company T-Shirt 22’

and you know it is EXACTLY the same as what you have bought from the factory and there is no marking on the T-Shirt of any Company name just says ‘T-Shirt 22’.

So, you are ‘L Sim Company’ and think that you will add to the ASIN and sell the same item.

The XYZ Company though as a Seller is annoyed and buys your items and makes you lose money.

The problem is that ‘XYZ Company’ is a registered Trade Mark owner, so even though T-Shirt is not even made by them, they ‘own’ that listing. Most Sellers think Amazon need to sort the issue out and not have the identical item listed lots of times, just with different brand names in the title, but they do nothing to help and in fact encourage such terrible Sellers.

All you can do is ‘if you can’t beat them, you have to join them’, and start a new listing with your brand name (ensure you Trade Mark your brand and issue it a new EAN barcode and you can do the same to any other Seller on your listing).

If however, you are both selling Levi’s and someone else is doing this, then more of an issue and I would suggest legal action, send a postal letter (NOT via Amazon) and ensure they take action.

I’d be tempted to send him a cease and desist letter. Then if he continues to order after this, send a ‘letter before action’ listing the costs incurred and that a claim will be submitted in the county court. Then submit a claim using the small claims track of the county court - really easy to do it online :slight_smile:
