Trademark Logo Misuse (Help)
Hi all,
I have been selling on Amazon for just under a year now and i still find myself finding out new things everyday, including some new violations that are affecting my account health.
I have 3 listings from my inventory that have been affected by this suspected violation.
Firstly i want to mention that i have invoices/receipts from distributors for the brands in question and only source genuine products and list them on the listings on amazon along with many others sellers.
I don't believe it to be naïve of me to see a listing of the branded product (A listing i did not create) and add to my inventory and send off units. A fairly normal process i believe. I understand from some digging on seller forums that although we can list on amazon it does not mean we are entitled to by the brand however i am not sure this is what this violation is referring to.
2 of the 3 listing didn't have the brand in the title but they did in the pictures and brand name
the other listing have the brand name in the title , description and pictures so i am ever more unsure on the logo misuse for this one.
Amazon states:
How to address the listing violation?
Products should be listed under the correct brand name intended by the owner of the trademark or the registered brand name. If the brand name for this listing is currently blank or has an invalid name, update the correct or complete brand name.
If you acknowledge the image(s) on the product detail page that contains a trademarked logo belonging to another rights owner, edit the ASIN’s detail page in one of the following ways before appealing:
1. Remove the trademarked logo from all images entirely for example, upload new images to the listing without any trademarked logos (or)
2. Change the brand name to accurately reflect the product and match trademarked logo used on the product detail page (or)
3. Update the detail page to add compatibility terms before the trademarked term, if the product is using the trademarked term to refer to another product, for example, “charger for Kindle E-Reader”, “charger compatible with Kindle E-Reader” or “charger made for Kindle E-Reader”.
Now as i did not create the listings , am i able to make these changes? I attempted to correctly input the brand name for the first 2 listings and the appeal was rejected.
As this is my first violation of this kind i am unsure on what to do? The only option I have when trying to appeal is to tick a box that i have updated the listing.

If it's a suspected IP violation. just remove the logo or add terms like "compatible with" etc. then submit an appeal indicating the root cause, corrective action, and preventive measure.

Unfortunately, I can only sympathise and none of the replies above address the root issue.
As you state you did not create the original listing you will find any attempt at making changes will be blocked by Amazon with their standard 'only brand owner can make changes'. What they mean by brand owner though seems to come down to either - the company listed under the brand attribute or the original creator of the listing.
I have so many products on sale where the info in the listing is wrong and every time I try to make a change I get that standard reply about 'only brand owner can make this change'. I have some products where the title is in French or refers to the item being something it is not,, where the brand is completely wrong, it has the wrong pictures, etc etc
I try to get the changes through - but sometimes I just decide to pull the item from sale - especially when the picture or description is so wrong it just disappoints the buyer, and results in negative feedback.
This kind of thing happens too often. Amazon send messages telling you to make changes. Support says the same. Then when you try you get blocked. And then you get stuck in a loop between being told to make changes that you cannot.
Occasionally, you get a Support person who actually understands and can help so by all means keep trying if you have the patience. You can also try emailing managing director. If you do send the the Case ID showing you have tried by the recommended route and getting nowhere.
