Fake counterfeit claim

Hello

I have received a counterfeit claim on a product that I bought from a reputable wholesaler. It is another distributor who is making the claim saying they are the only Amazon seller allowed. How can this be right? They are a wholesaler the same as me. I am a new seller, can someone help please?

Did you check that you are allowed to sell the brand on Amazon. Some brands are very protective and will only allow themselves or select sellers to sell the brand.

Have you tried to talk to the wholesaler about it to determine if there are any issues selling the product on Amazon. Some wholesalers are more helpful than others in this matter.

If the other party does not have a legitimate right to sole distribution rights on Amazon then you could think about raising their behaviour with the brand owner.

If they do have sole distribution rights on Amazon there is probably not a lot you can do. I don't believe it is right for this to happen but it does happen.

Assuming you have invoices from the wholesaler you can use this to try and appeal the violation. If Amazon do overturn the violation then the other party may however issue further counterfeit claims.

It's probably also worth checking - does the brand link on the ASIN in question actually match the brand of the product?

We have some brands that do not permit selling on Amazon or eBay at all. That's fine, but if a brand, manufacturer or distributor tries to restrict who can sell on Amazon, that would be in breach of the anti-competition regulations. It could be construed as forming a cartel or abuse of a dominant position in a marketplace. Perhaps you could point this out to the claimant and your wholesaler. There can be big fines for breach of these regs.

Lets see if I can break the record of thumbs down on this one.
