Confused on polybag suffocation warning

Hello,

New seller. I am selling a kitchen item.

I have 2 polybags from Amazon FBA (personal purchases) that DO NOT have a suffocation warning despite opening >5 inches.

FBA Prep instruction says bag must have warning.

What is correct?

Thanks in advance.

You must have a suffocation warning label on the poly bag. Doesn't matter if other sellers don't do it -- you need to.

FWIW, years ago I was reading the federal guidelines/rules and technically you only need a suffocation warning on things packaged in plastic bags that are meant for children. But in this age of litigation -- warnings are everywhere. We even put warnings on poly bags with 4" openings. Easier to just do it than to argue with Amazon later.

Note that there are several states with stricter rules; Amazon makes sure that our products comply with the strictest of these rules.

To the OP; as you gain experience selling on Amazon, you will run into many situations of people getting away (for a time at least) with not following the rules. Don't let that drag you down into not doing the right thing.

It's easy enough to purchase polybags that already have compliant warnings printed on them. Much easier than labeling them yourself.
