Plan Of Action Attempt No.4

I've been working with Amazon Health Support to write and review my Plan of action to appeal a IP and Trademark Deactivation. On my second attempt, Health support said my appeal was good and well written and offered some pointers I could change, that appeal got rejected and I was given a generic email to go into greater detail. My appeal was a page and half. On my third attempt I wrote a 5 page Plan of Action appeal and I called support for advice on it, after nearly an hour call, I was told it was perfect and I should submit it and I did. Rejected again. I need help on what's missing, if I'm writing too much or too little. Or if it's even possible to get your account back after an IP deactivation. I don't even think an outside consultant agency can even help me at this point. Here is new 4th iteration below:

This is [ My store name ]. I am writing this appeal letter in regards to the suspension of my Amazon account. For all the notices and warnings leading up to the deactivation on August 10th, 2024. After carefully reviewing the reason for my suspension, I have developed a detailed comprehensive plan of action to ensure that addresses all concerns My latest plan of action and solutions are outlined below:

Root cause of problem, Identifying the issue in greater detail. I wish to address the multiple account violations which include Suspected and Counterfeit Claims, Trademark and Copyright violations such as Bubble, ILIA, Ouai ELF, JVN and generic branded products I have identified the main issues that led to my suspension after reviewing the deactivation email and looking at Amazon’s "Intellectual Property Violations" page.

I failed to read Amazon’s guidelines on Intellectual Property Policy for Sellers

I committed copyright, trademark violations by making generic listings of named brand items like ELF lip glosses without permission by Brand. B084C2PC69 (Trademark), B0B137RLYG (Trademark) B0CLSC9Z52 (Copyright)

I added ungated Bubble, Ouai, JVN, ILIA to my catalog without proper approval of Brand or properly sourced methods that has caused many suspected counterfeit and or counterfeit claims brand and IP complaints ASIN: B0BSYJYQY2 (Counterfeit), B09QM1PBQ2 (Suspected Counterfeit), B0B6JMGP4S (Suspected Counterfeit), B097Z6XN9B (Suspected Counterfeit) See below for more detail on this

Furthermore, These products were automatically ungated when I applied to sell them and I added them to the catalog lacking proper authorization. I did not check that ungated doesn’t mean that the brand wouldn’t issue a complaint. This isn’t brand approval. The brand owners were unsure of where I sourced the product or if I had brand approval and I was served violations as a result. My intention was never to provide customers with inauthentic or suspected products. I haven’t consistently sourced from reputable suppliers or stores with an approved invoice. I understand this isn’t adequate. For example, I’d purchased Bubble inventory from Walmart.com but Walmart has Bubble listings from Bubble itself and listings from 3rd Party sellers. But I’d source from both places which I understand how that may cause an issue of authenticity. Here’s my solution:

Correcting the issue in greater detail: I have taken immediate action to correct the issue.

I have removed all Bubble, Ouai, ILIA, JVN listings from my Amazon catalog

I destroyed any remaining product inventory as well as any item suspected of counterfeits.

I will not create any more generic listings that impede on trademark policies of brands and their owners.

I have halted all listing creation

I have created an inventory inspection sheet and employee training guide

to further help guide myself and others to verify quality assurance.

You may already have seen some of these on listing removals corrections on my account health, slowing improving the score

This is a training guide I created for myself and any employee I may hire, they are to read and understand it. The inventory inspection sheet should confirm the source of product, website, supplier and address and also include inspection of each unit. Inspection of packaging, labeling. Seeing if there’s any damage or spilled contents, etc. To ensure the best customer experience.

In addition, I’ve reached out to every Brand Owner in the Notice Policy Warnings and offered an email apology and asked for a retraction. I have also notified them of the removal of my listings.

I will prevent future issues and IP complaints, suspected counterfeit , copyright and trademark violations in greater detail by not making generic listings of named brand items or anything that infringes on brands to avoid trademark, copyright or counterfeit claims. I will increase vetting of my sources both wholesale and retail. How will I do this?

Going through the gating process, getting ten units(X) providing all photos and invoices

Not adding any item to my catalog even if it’s ungated and automatically approved.

I will get brand letters approvals of each brand and Amazon moving forward,

I will source directly from authorized brands and manufacturers and not third party sellers.

Automatically approved ungated items, I will email the brand for reselling approval then request an official list of authorized distributors of goods to source. .

I also educated myself further by reading "Intellectual Property Violations" and all the IP Information provided in Seller Central Help.

We will cross check trademark and IP complaints of ASINs and also check for patent and trademark registrations on the USPTO website before creating new listings on Amazon.

Inspecting product packaging and labeling on arrival to store before shipping out.

I will address account health and notice policy warnings sooner rather than later and attempt to remedy situations much earlier with proper documentation and approvals to sell.

As a new seller on Amazon just under a year of selling, I now am better equipped with the knowledge of what it takes to sell on Amazon.com having read the "Intellectual Property Violations" in Seller Central Help. Please accept this detailed plan. I would love your assistance and feedback moving forward in this process. Thank you for taking the time to review my appeal letter. Great, NOW you know what you should have known BEFORE you started selling.

Unfortunately for you, the entire letter should be used as a warning to every new seller on Amazon as to what NOT to do.

You violated so many serious things -- both Amazon polices AND US laws -- that I don't see any way forward for you on here.

Find another venue BUT learn their rules BEFORE you start selling there.

That was your first mistake. Your appeal should be about 1/3 of this wall of text you posted here.

They will not reinstate your account. Just because there is an option to appeal, doesn't mean they actually read your appeal. Certainly not if they are put to sleep 2 lines in.

I committed copyright, trademark violations by making generic listings of named brand items like ELF lip glosses without permission by Brand. B084C2PC69 (Trademark), B0B137RLYG (Trademark) B0CLSC9Z52 (Copyright)

I added ungated Bubble, Ouai, JVN, ILIA to my catalog without proper approval of Brand or properly sourced methods that has caused many suspected counterfeit and or counterfeit claims brand and IP complaints ASIN: B0BSYJYQY2 (Counterfeit), B09QM1PBQ2 (Suspected Counterfeit), B0B6JMGP4S (Suspected Counterfeit), B097Z6XN9B (Suspected Counterfeit) See below for more detail on this

Furthermore, These products were automatically ungated when I applied to sell them and I added them to the catalog lacking proper authorization. I did not check that ungated doesn’t mean that the brand wouldn’t issue a complaint. This isn’t brand approval. The brand owners were unsure of where I sourced the product or if I had brand approval and I was served violations as a result. My intention was never to provide customers with inauthentic or suspected products. I haven’t consistently sourced from reputable suppliers or stores with an approved invoice. I understand this isn’t adequate. For example, I’d purchased Bubble inventory from Walmart.com but Walmart has Bubble listings from Bubble itself and listings from 3rd Party sellers. But I’d source from both places which I understand how that may cause an issue of authenticity. Here’s my solution:

Correcting the issue in greater detail: I have taken immediate action to correct the issue.

I have removed all Bubble, Ouai, ILIA, JVN listings from my Amazon catalog

I destroyed any remaining product inventory as well as any item suspected of counterfeits.

I will not create any more generic listings that impede on trademark policies of brands and their owners.

I have halted all listing creation

I have created an inventory inspection sheet and employee training guide

to further help guide myself and others to verify quality assurance.

You may already have seen some of these on listing removals corrections on my account health, slowing improving the score

This is a training guide I created for myself and any employee I may hire, they are to read and understand it. The inventory inspection sheet should confirm the source of product, website, supplier and address and also include inspection of each unit. Inspection of packaging, labeling. Seeing if there’s any damage or spilled contents, etc. To ensure the best customer experience.

In addition, I’ve reached out to every Brand Owner in the Notice Policy Warnings and offered an email apology and asked for a retraction. I have also notified them of the removal of my listings.

I will prevent future issues and IP complaints, suspected counterfeit , copyright and trademark violations in greater detail by not making generic listings of named brand items or anything that infringes on brands to avoid trademark, copyright or counterfeit claims. I will increase vetting of my sources both wholesale and retail. How will I do this?

Going through the gating process, getting ten units(X) providing all photos and invoices

Not adding any item to my catalog even if it’s ungated and automatically approved.

I will get brand letters approvals of each brand and Amazon moving forward,

I will source directly from authorized brands and manufacturers and not third party sellers.

Automatically approved ungated items, I will email the brand for reselling approval then request an official list of authorized distributors of goods to source. .

I also educated myself further by reading "Intellectual Property Violations" and all the IP Information provided in Seller Central Help.

We will cross check trademark and IP complaints of ASINs and also check for patent and trademark registrations on the USPTO website before creating new listings on Amazon.

Inspecting product packaging and labeling on arrival to store before shipping out.

I will address account health and notice policy warnings sooner rather than later and attempt to remedy situations much earlier with proper documentation and approvals to sell.

As a new seller on Amazon just under a year of selling, I now am better equipped with the knowledge of what it takes to sell on Amazon.com having read the "Intellectual Property Violations" in Seller Central Help. Please accept this detailed plan. I would love your assistance and feedback moving forward in this process. Thank you for taking the time to review my appeal letter. I humbly ask for my account to be reinstated so that I may continue selling on this platform to sustain my livelihood.

Great, NOW you know what you should have known BEFORE you started selling.

Unfortunately for you, the entire letter should be used as a warning to every new seller on Amazon as to what NOT to do.

You violated so many serious things -- both Amazon polices AND US laws -- that I don't see any way forward for you on here.

Find another venue BUT learn their rules BEFORE you start selling there.

They will not reinstate your account. Just because there is an option to appeal, doesn't mean they actually read your appeal. Certainly not if they are put to sleep 2 lines in.

I've been working with Amazon Health Support to write and review my Plan of action to appeal a IP and Trademark Deactivation. On my second attempt, Health support said my appeal was good and well written and offered some pointers I could change, that appeal got rejected and I was given a generic email to go into greater detail. My appeal was a page and half. On my third attempt I wrote a 5 page Plan of Action appeal and I called support for advice on it, after nearly an hour call, I was told it was perfect and I should submit it and I did. Rejected again. I need help on what's missing, if I'm writing too much or too little.
