Declaration of Conformity (Toy) for.. Bang of Sand
Hi, I’ve read about 10 similar threads concerning this, but can’t seem to get the answer I’m after.
We sell Play Sand - 25KG Bags, we have them in the category “Grocery” when the listings were created, but they’ve been re-categorised on the Amazon Side to Toys.
Last year this was one of our best sellers and was then flagged by Amazon as a “toy” with the usual notification, to provide Declaration of Conformity, or photograph of CE Marks etc. The thing is, this doesn’t have a CE mark, as its a bag of sand. It’s not a toy, or intended to be a toy.
There are other sellers (not the manufacturer as they are not on Amazon) on Amazon selling the exact same item and brand, so I don’t understand why theirs haven’t been flagged, or how they have gotten around this.
So last year after weeks of back and forth with Amazon, 99% of the time receiving the same automated response. And hours and hours spent on live chat/phone calls for them to then “refer” me somewhere else and never hear back. We lost all of our listings. Very frustrating, these were listings with well over 100 5 star reviews etc.
So this year, we re created listings, spent quite a bit on advertising to get them going, and started selling again. And yesterday every single variation (number of bags) has been flagged again.
I don’t know what to do at this point, it is one of our biggest sellers from April to September. Any advice would be much appreciated

We have had this issue. You need to discover why Amazon think it’s a toy. In your case, the main reason is that it’s in the toys and games category.
You also check your keywords, bullet points, description. And remove/edit anything that relates to toys/kids/children etc. This is what Amazon are picking up.
On a side note, who the hell buys a bag of sand on Amazon.

It is play sand and therefore it IS a toy and needs safety checks, what if there is something caustic in there that gets into a child’s eyes?

Sounds like it’s “play sand”, which if was not pure and full of acid / lead etc could cause poisoning…
So needs CE mark.

Just another note, there is no notifications of any of these flagged listings under “Product Compliance”, so I can’t add documents even if I had them. I’ve tried telling them this and just keep getting the original automated response

You need to get your supplier to go through the relevant testing so they are compliant. If they won’t do this then you can pay a recognised testing organisation to do it, buts it’s not cheap. The alternative is to find a supplier of play sand who has gone through this process, is compliant, and therefore has the necessary docs you need for your DOC.
I’m assuming you are selling in Europe, as the DOC requirement is an EU thing not a U.K. thing.

Its easier to not sell in toys n games market.
Let amazon sell if this market they have it all covered.
Move on to other categories, it would be an easier 5 years of sales in future.
You keep selling in toys and games, and you will get more rules and policies ahead only to think you’ve mastered them all and then a customer comes and says her son’s younger brother 2+ swallowed a chess piece and now it stuck in his lung.
Even though the game had ages 3+ On it.
Now whats next, your in with trading standards, amazon blocks your account and asks for a business plan and your girlfriend has left you.
Plan your business plan beforehand, dont get stuck into writing one.

So we are putting together the DOC, and the Tech Document etc. So the CE issue should be sorted asap.
The only other problem is that, the “Product Compliance” page under performance notifications shows “0 Issues”, so we can’t upload documents even if we had them. The listings are also all still active on Amazon.
I’ve tried explaining this, in detail with screenshots, in the open cases and just keep getting the same automated response back saying the item is a toy and needs documentation and to submit this under performace > product compliance. sigh
