Amazon Appeal for Asin resinstatment

Hiya,

Could do with some advice here. I had a Asin blocked on the Amazon Merch on demand Platform due to a copyright claim from a "rights owner".

It is for a parody "Just stop oil" T-shirt. The Claim wasn't even made by just stop oil its from some random guy with a "yahoo email"

I of course checked the trademark for "Just stop oil" prior adding the product and there is no active trademark for the phrase "just stop oil"

The asin was conveniently suspended just before the xmas peak period and i was the number 1 seller. There are many designs with "just stop oil" currently selling.

I have submitted over 20 appeals and keep getting the same automated response below:

Thank you for your message. We cannot accept your appeal because it does not address the report we received from the rights owner. Please provide the following information so we can process your appeal:

Proof of product authenticity (e.g., invoice, Order ID, licensing agreement, letter of authorization). It must clearly prove that your products do not infringe any intellectual property rights. Please send this information, any other documentation, and a list of impacted ASINs to xx.

Greater detail on why you believe an error has occurred.

Obviously I can't provide an invoice etc as it is sold through amazons merch on demand platform.

Please see my appeal below and any thoughts would be greatly appreciated:

Dear Amazon Intellectual Property Team,

I am writing to provide a detailed appeal against the infringement claim for ASIN B0C*****. I understand the importance of upholding intellectual property rights and wish to present a comprehensive response addressing all the points requested by Amazon.

Proof of Product Authenticity:

Please find attached the documentation from the UK Intellectual Property Office confirming the refusal of the trademark application for "Just Stop Oil" (UK00003844156). This document verifies that the phrase is not a legally recognized trademark and substantiates the authenticity of my product in not infringing on any intellectual property rights.

Detailed Root Cause Analysis:

The infringement claim appears to be based on a misunderstanding regarding the trademark status of the phrase "Just Stop Oil." As mentioned, this phrase is not a valid trademark in the UK, as per the Intellectual Property Office's records, which I have submitted for your review.

Actions Taken to Resolve Issues:

I have attempted to contact the rights owner, ********, to discuss the claim and seek retraction but have received no response. I intend to resolve this issue amicably and promptly.

Steps to Prevent Future Infringement:

I am committed to avoiding any infringement of intellectual property rights. I will continue to conduct thorough research to ensure that all my products comply with Amazon's policies and intellectual property laws before listing them.

Explanation of Non-Infringement:

The key factor for non-infringement is the invalidity of the trademark claim, as evidenced by the attached Intellectual Property Office document. My product does not feature any copyrighted design elements or logos that are legally protected. The phrase "Just Stop Oil" as used on my T-shirt does not correspond to any registered trademark, and therefore, there is no legal basis for the claim of infringement.

I respectfully request that the provided information be carefully reviewed, and I seek a re-examination of the decision to remove my ASIN B0C*****. I believe that an error has occurred, given the unregistered status of the phrase in question.

I am fully prepared to comply with all of Amazon's policies and take responsibility for ensuring that my listings adhere to the necessary intellectual property guidelines. My goal is to resolve this matter and continue to provide quality products to Amazon customers.

Thank you for your attention to this matter. I am eager to resolve this issue and I am willing to provide any further information required. Please do not hesitate to contact me if there are additional details or clarifications needed.

I look forward to your prompt response and hope for a positive resolution that will allow the reinstatement of my ASIN B0C*****.
