Update to EU VAT establishment determination

We recently updated our European VAT calculation services methodology for Business-to-Business (B2B) sales to ensure that VAT is applied accurately based on your country of establishment.

Starting September 11, 2024, information received from the relevant Tax Authority–such as the address or the format of your VAT Registration Number will take precedence over the Registered Business Address you provide to determine your establishment status (for the UK, Spain, or Italy).

If the information received from a Tax Authority indicates you’re non-established, non-resident domestic reverse charge rules will apply to your B2B domestic sales, in applicable countries, with no VAT applied rather than the local VAT rate.

I have been having issue with this with Amazon for the last 3 weeks, we have submitted a letter which is from HMRC which states that we our established in the UK and have a valid UK VAT Registration Number but still Amazon have not disbursed any funds to us.

Is there anyone that can support us on this and resolve this issue

We have submitted a letter from Individual and Small Business Compliance (ISBC) HM Revenue and Customs (isbcvatestablishment @ hmrc.gov.uk) to the Amazon Account Health Team at kyc-drtax-verification@amazon.co.uk on multiple occasions. This letter states the following:

“Our decision

We have accepted the information you have given us and have decided that you are established in the UK for VAT purposes. You can send this letter to the online marketplace to show evidence of your UK establishment status.”

Signed by the Campaigns and Projects, HM Revenue and Customs.

It has now been more than 4 days since the requested information was submitted to the Account Health team for review.

Can someone from Amazon please help because this team is not responding?

Amazon does not apply EU or UK VOEC regulation to B2B sales anyways, I am not sure what is changing right now by applying domestic reverse charge rules rather than the applicable VAT which has never been applied or collected by Amazon. Could you kindly explain? Thanks.

Please advise what EORI numbers should be used for the countries that require your specified VAT numbers such as Norway and Australia etc
