Competitor Trying to Wipe Me Off Amazon
Hello Amazon Seller Community and Moderators (@CR_Amazon, @Cade_Amazon, @Stevie_Amazon or anybody, please!)
I’m posting this because I recently received a trademark complaint from a competitor, claiming that my product infringes on their intellectual property rights. However, my product is entirely unique in branding, design, and content, with no references or imitations of the complainant's brand. This complaint appears to be an attempt to gain an unfair competitive advantage by removing my product without valid grounds.
Here’s a summary of the key points and evidence I’ve submitted to Amazon Seller Support, all of which clearly demonstrate the originality of my product:
Copyright Registration: My product’s unique text and artwork are protected by U.S. copyright registration. This provides legal assurance that my content is original and independent, with no overlap or infringement on any other brand’s intellectual property.
Pending Trademark Application with USPTO: My brand name has been filed with the USPTO and is currently pending approval. This reflects my commitment to building a legitimate and distinct brand identity, separate from any other similar products in the marketplace.
Independent Branding and Design: My listing, title, keywords, and all content are specific to my brand. I do not reference or attempt to imitate the complainant’s brand anywhere in my product details. The brand names themselves are distinct, with different primary terms, making confusion unlikely.
Invoices from Manufacturer: I have submitted invoices demonstrating a legitimate supply chain, confirming that my products are independently manufactured and sourced. This supports the originality of my product and further disproves any claim of imitation or infringement.
Generic Product Category: Both products fall under a general category of items, which is not exclusive to any single brand. The complaint seems to be an attempt to claim rights over a generic product type rather than a specific brand element.
Despite presenting all this documentation, my appeal was rejected, leaving my listing at risk of removal. The complaint IDs associated with this cases are 16545591821 and 16545354841 (same reasoning for the compliant), and the Case ID with Amazon Seller Support is 16580852251.
My product has a rightful place on Amazon, and it’s crucial for sellers to be protected from unfounded claims that jeopardize fair competition.
Thank you for your time and attention to this matter. I appreciate any assistance or guidance to ensure a fair resolution.
Best regards, Max

Hello @Atlas_Amazon,
Thank you for your response.
The primary issue is that all my appeals and document submissions have been rejected for over six days. I am highly concerned that the current submission will likely be rejected as well.
The root of the problem seems to be a misunderstanding on Amazon’s end, where it appears they are convinced I am selling another brand’s product, which is not the case. The only documents they are currently accepting are a Letter of Authorization, a valid invoice proving the purchase of another brand’s product, or a complaint retraction—none of which are applicable to my situation, as this is my own brand.
Despite providing evidence, including images of the product, the fact that I have not used any other brand’s name in the description, and proof of my own brand registry and U.S. copyright registration, it seems that Amazon's team has not considered the possibility that this is my original product.
Please advise on how we might proceed to clarify this situation effectively.
Best regards, Max

Hello @Atlas_Amazon
There is a technical glitch that is preventing two of my ASINs from being reinstated.
Complaint ID: 16545354841
The original notification from October 27, 2024 listed only 2 affected ASINs, but in reality there were 4 ASINs that were affected and got blocked.
I addressed this issue and was able to handle the listed in the notification ASINs and got them reinstated. BUT. The other two are stying blocked. And I have no Account Health Notifications, no appeal options. nothing.
I handled the copliant but still these two ASINs show as the copyright infirigement.
Can you, pelase, help me fix this?

Hello @Atlas_Amazon
It has been about 2 weeks now that they are reviewing the case with no progress. Is there a way to find out what is going on?
I have this ID 16644696271 that I received on 11/11 that contains instructions to upload requested documents. But none of the instructions are relevant. The Account Health Specialists that I talked to on the same day (11/11) both assured me that there are no steps that I need to take in order to continue the progress, that the ball is on the review team side and I should just wait.
But I am afraid that the team is expecting something from me that I am unable to provide (due to technical issues on the Amazon side) and there will be no progress.
Black Friday is approaching fast and I need to resolve this ASAP. Please help me!

Good morning, @Atlas_Amazon
Thank you for the update. This is a very straight-forward issue—all the documents proving that I am not in violation of anybody's trademarks, nor Amazon TOS, were provided almost a month ago. I don't understand why this is taking this long. It literally shouldn't take more than 1-3 minutes to understand that these ASINs are perfectly fine and reinstate them.
I am losing sales, as these are the 2 out of 3 of my most popular ASINs.
Please, help me get this solved.
