Amazon selling fake goods on our listing...How do we get them to stop?

We have an FBA only business, and just recently things have been going wrong with our best selling item.

Firstly, someone decides to authorise the brand name to be changed, along with the photos, the part number and the item description?! Didnt think this was possible, or is this just amazon playing about?

Secondly, they started winning the buy box every time, to the point where we would get only 1-2 sales per day, when normally we would sell around 50-100 of that same item daily. Whenever we tried to reduce the price, amazons auto repricer would match our price, and they would win the buy box every time… Never been in this situation, so would like any assistance to get this resolved in the best way. We’ve tried opening cases with all sorts of departments and they keep getting ignored or transferred, not actually getting a response.

Lost so many sales since this has been happening, to the point we feel like just quitting, as we are basically paying to advertise our listing, but not getting any sales.

The worst bit is, we did a test purchase, and the item isnt anywhere near the same item, its some dodgy chinese copy that looks dangerous. I’ve tried reporting this to amazon, but surprisingly its being ignored…

Its not even a case of brand registry, we are registered for that now, but regardless, its not the same item, which i thought was against their own policies?

Totally stuck.

Any genuine help appreciated.

They are stealing our money marking FBA as refunded. But what’s the reason.
Never been like this with our fulfilment.
We have now three FBA refunds in one month and I do not know what’s the reason and where the item is.
They also charging us 50 percent fee for FBA. I am just getting furious.
Have emailed seller support but they are just nuts (as always have been).

The days of rebranding generic Chinese goods and claiming them as your own are long gone.

You need to accept this is the way amazon operate.

You aren’t the first one to have Amazon do this to them. One seller even got blocked from selling the real product while Amazon continued selling fakes. It took them months to get Amazon to stop and another few months to get unblocked… And then after all that effort… Amazon did it again.

It used to be such a fantasic company, but these days they are morally bankrupt and clearly have no respect for their buyers or sellers.

Hello there - Sorry to hear this is the situation. _ If as I presume you do , have a legally registered Trademark, in the U.K / & all other market places you sell your wares my friend.

Your first port of call would be to inform the Catalogue Team of this right away. Demand why , & how another seller or Amazon associate also was able to thereby amend a ‘Legally Protected Trademark’ under copy right laws.

Send them, (scan it) upload your Trademark Registration form. And what will certainly (on a legal standpoint) cushion you further would be if you are enrolled under Amazon’s ne Brand Registry.

Mention that if this is not reseolved you will refer this entire shambles to Jeff Bezos Team to investigate.

Hence, they will act swiftly.

It is a untrained Amazon Catolouge rep. - Who also for us, ripped apart our listing a couple years ago, - After a phone call from a fellow seller who was NOT, repeat Not selling a similar product.

Be weary, . . . I reported it & in moments the associate had a quick word to his fellow colleagues in the same call centre & back to back I got two Violation Notifications on an enitirely different issue.

I wrote an email to the man in charge, - Explained , provided concrete proof , not only of the fact I manufacture an absolutely different product, but that, my listing was not only deleted from the Catalogue & that something internal (sinister) was at play.

The chap who delted it, . . .by way of a simple phone in from another seller to allow him to offer a similar, (but in nature) a inferior product .

I mentioned he had broken , then deleted , then had me have Policy Violations for a small seller as we are, & has caused undue distress. He called me, re instated my listings. (all back to front ) _ Silver lining, & I took it. Never have been with that item a best seller or even close ever again due to sheer negligence.

So my friend, tread carefully - Use your acumen, - If all else fails - Send photograpic evidence in terms of your Brand REgistry on AMazon, & countries you have Trademarked your item, packaging & so forth under the new Brand REgistry guidelines.

If you have no joy , make it crystal clear you will send this to be reviewed , investigated, & more over want an exlanation as to how any Amazon Catolouge assoiciate had any , ANY legal right to assert, ammend a product you manufacture & have Copy Right Laws protecting you from anybody whereever, Amazon or not to break the law.

I sincerely hope this wayward guidance may help you.

Amazon is a third party platform for which, if you then want to consuly a Solitor $700 odd dollars, you ought to if there is no joy. FIle a legal suit that breaches Amazon’s T+C’s & for lost income would also like compensation for lost revenue.

The legal way is the best bet. … .But diplomatic baby steps I advise is best in my opinion. They will internally resolve it, … .& ulike my issue, I hope your outcome is more forthcoming & that listing you garnered through immense hard work I trust has been taken from you on legal basis.

Amazon, Alibab, hell Warren Buffet & Bill Gates all have to work within the law.

Good Luck. - I’m sure with careful & concise legal Acts (must research or consult) you will be back on top again.

Good Night,

Blessings.
