Counterfeit Without a Test Buy claim

Hey guys I was hoping to get some help as I tried to raise this with seller support but did not get anywhere. I received a claim from seller: ‘imporio11’ on the following ASIN: B09P6MXN18. The original brand is actually ‘pet touch’ for which i have invoices from a wholesale supplier. However, unknowingly I did not spot that this seller has actually photoshopped the item and named it ‘pet guru’. They then put a claim against me saying the items I was selling were counterfeit. It is quiet clear the seller is selling pet touch items and rebranding them as ‘pet guru’ and now I have a claim against my account. For reference i have attached the original item without the photoshop and the listing picture with the photoshop. I appreciate any help you can offer. Thank you

There isnt much you can do as your invoices wont match the product you’ve listed against so you just need to stop selling them on that listing. Did you list using the barcode on the product or just see that the pictures were the same?

So the barcode on your product matches that listing? The barcode on that listing belongs to Imporio Trading
You do always need to check the brand as well when you check a product

my apologies for the confusion, no the barcode on the product does not match the one on the listing. When scanning on selleramp it bought several listings and i just selected it due to the similarity. Do you think it would be useful to actually purchase an item from the listing and see if it indeed comes labelled as ‘pet guru’ as advertised? Thanks for your help

Ah right, I will do. Is there anything I can do in an attempt to get the counterfeit claim removed as technically the goods sent weren’t counterfeit and I have invoices to prove? Thank you for your help

We have previously been advised by seller support that we have to accept the mistake and then ensure we do not sell the item again. They told us that our account would be at riks if we did not though we sent them evidence that the complaint was malicious.

This happened August last year and we have been ok since then

It’s very common on Amazon to see a photoshopped product with a slightly changed brand, one of a range of products I sell have a life of its own as another brand, they just changed the M of the name into a V. Packets and logos are the same The fake one is even Amazon’s choice. I sell on the correct EAN with the correct photos but I was wondering what the actual law says about it? AC_SL1000 AC_SL1500
