Brand Registry Denied
Hi Everyone,
I recently applied for Brand Registry using my pending USPTO application, but to my surprise, the application was denied. The reason given was:
"We are unable to approve your Brand Registry application because the trademark on the application either violates the intellectual property rights of others and/or is highly likely to be confused by customers with an established brand."
Has anyone encountered a similar issue or have any advice on how to address this? I’d greatly appreciate any insights or suggestions on how to fix this.

I have had a USPTO application denied for being to similiar to another registered mark. This is likely what Amazon is seeing. More than likely your pending mark will get denied and you will have to start over.
To get around this I do some initial investigation on my own to make sure the mark I put the application in is not to similiar to an already registered one.
We just had our second mark published a few days ago, yay!

The reason you received that messaging is because there is already a separate brand enrolled in brand registry with the same type of products as your brand. If they were different product classes but the same brand name, then there would be a path forward.

Is your brand registry application been approved or denied, bit of a mixed message.
I looked at your store name "Native Fragrances" and im sure your aware that there is a "Native Deoderant" brand registered by P&G already. Are you or your brand also called Native Fragrance? Are you or your brand associated with P&G?
