Issue with Brand Registry approval of the same trademark in US

Hi,

I’ve had a trademark I want to register in both the UK and US, so far I have it approved on brand registry in the UK. I was rejected by brand registry for approval in the US, they stated:

‘Your Brand Registry application has been declined as we have identified the trademark from your application as related to a brand that is already enrolled in Brand Registry.’

Yes I have the trademark registered in BR but only for the UK, none registered with the same mark in the US.

I’m approved for the trademark in one brand registry account. I applied for the US trademark in another brand registry account as I heard the US and UK need to have separate brand registry accounts

Please advise

This is correct. Without a US trademark you cannot brand register in the US.

Have you checked whether your trademark already exists in the US? Possibly someone already has it registered on Amazon?

Hello @ BASEUK,

Welcome to Amazon Brand Registry!

As mentioned by @ PeterB, you will need a US Trademark and UK Trademark to register for the US Brand Registry and the UK Brand Registry. As shown on the image shared by you, you will have two Trademark offices registered and they will be valid autonomously in the US and UK marketplaces.

Below I am sharing links to help pages, where you can review the Trademark verification process for both countries:

Amazon Brand Registry
Enrolment guidelines for accepted trademark offices
Enrolment guidelines for the UK
Enrolment guidelines for the US

Please let us know, if you have more questions

Kind regards,
Julia.
