Looking for Feedback Regarding my POA

Hello Everyone

My account got deactivated for 3 IP complaints. Copyright piracy was the root cause on all 3 complaints. Below is my second POA and I was hoping to receive some feedback before submitting.

Amazon instructed us to include the following:

-- Greater detail on the root cause(s) of the infringement.

-- Greater detail on the actions you have taken to resolve the infringement issues.

-- Greater detail on the steps you have taken to prevent infringement going forward.

-- Evidence or examples that demonstrate your account complies with our piracy policy

Please let me know if anyone has questions

Thank you!

Hello,

We are writing to appeal against the suspension of our Amazon Seller Account, Bookseller909. On June 21st, we received an account suspension notification due to repeated violations of the intellectual property policy. Since receiving this notification, we have reviewed the proper Amazon policies, investigated the reasons that have caused the issue and implemented a plan of action to ensure that these policies will not be violated again.

Our account violated Amazon’s intellectual property policy by unknowingly committing copyright piracy when selling the following items:

• ASIN: 0323532020

Title: Pocket Companion for Physical Examination and Health Assessment

• ASIN: 0133871312

Title: Framework for Marketing Management

• ASIN: 1337406295

Title: Issues and Ethics in the Helping Professions

I. We have identified four main reasons that led to us causing copyright piracy:

a. We unknowingly sold and distributed inauthentic textbooks to customers through our Amazon account that were deemed counterfeit.

b. We sourced these three books in an unreliable way, via student buybacks held at bookstores we own.

c. Staff members listing books were not proficient in Amazon’s intellectual property policies and would not know how to identify counterfeit books.

d. Management ignored policy warnings about listings being unauthorized reproductions of copyright materials. Management was unaware they needed to respond to said warnings.

All three textbooks deemed counterfeit were purchased from three different students at a bookstore we own in (Removed for post). These books were then shipped to us to be listed in our warehouse via our seller account Bookseller909. The buyback receipts for all three books are attached.

II. To resolve these issues, we have implemented the following changes:

a. All listings on our Amazon seller account were reviewed and we permanently closed any listings with the ASIN of 0323532020, 0133871312 & 1337406295.

b. We have reached out to our publisher representatives to help us identify books that may cause any infringements.

c. All listed inventory was then pulled to be inspected for any infringements based on the information given to us from the Publishers.

d. We flagged the three ASIN’s via our POS to ensure none of our stores would ever purchase them on any secondary market.

e. We’ve reached out to the third-party software we use to list books and instructed them to block the listing of the three ASIN’s.

f. We reviewed our account health dashboard and addressed all violations and complaints.

III. To prevent any further issues, we will do the following:

a. When sending us inventory to be listed online, all bookstores are prohibited to send any purchased books from students.

b. All bookstores supplying us books to list online will need to verify their suppliers.

i. A supplier will need to provide us with such things as a complete name, business name and address. The bookstore manager will be responsible to document all of this. If a complete supply chain cannot be traced back to the book’s publisher, our bookstores are instructed to avoid that supplier.

c. All employees will need to complete training on Amazon’s “Comply with Amazon’s Intellectual Property Policy” video on Amazon Seller University.

d. All employees will need to be familiarized with Amazon’s Anti-Counterfeiting Policy as well as be able to avoid/identify counterfeit books.

i. To help us avoid/identify counterfeit books, we developed a multi-point inspection process to help train our employees. I have attached this process.

e. All employees will need to become familiar with and be able to interact with our account’s health dashboard on Seller Central.

f. We will development better communication with the Rights Owners and obtain all necessary permissions before listing their books.

These changes and new procedures to our business practices will ensure all future listings and orders will exceed Amazon’s specific requirements and no longer infringe on any policies. We will continue to monitor our account health dashboard to ensure there will no longer be any future violations.

Thank you for your time.

You have the framework down. You admit fault, bullet points, short sentences, easy to understand the language.

The only suggestion is that it is about three times too long.

If you can find a way to reduce it to a much smaller edition it might help.

The BOTS and any real people have short attention spans and are required to meet 'production' goals so they will stop reading after about three sentences.

Well, I changed my POA slightly and submitted it. Once again Amazon gave me the same response. The revised POA I submitted is below. I wish I could get an Amazon Moderator to respond. Any suggestions on what I should change with the POA???

Thank you!

Amazon's recent response:

-- Greater detail on the root cause(s) of the infringement.

-- Greater detail on the actions you have taken to resolve the infringement issues.

-- Greater detail on the steps you have taken to prevent infringement going forward.

Hello @Seller_dwnYviuli6RY0,

Thank you for posting on the Forums.

"My account got deactivated for 3 IP complaints. Copyright piracy was the root cause on all 3 complaints. Below is my second POA and I was hoping to receive some feedback before submitting."

I see that your account has been deactivated for 3 separate complaints of copyright piracy and you would like some guidance on the appeal you are submitting.

First, I want to call out that typically, if your account has been deactivated for intellectual property concerns, a plan of action alone will not be accepted to reinstate the account. Along with the plan of action you will want to submit evidence that demonstrates your account has and will complied with our piracy policy.

To improve the appeal, I suggest to add quantifiable information in your steps, for example: if your employees "will need to" or "will need to be" trained on policies, when will they be trained and how often? (1st of every month all employees will review the Intellectual Property Policy for Sellers help page) An appeal is intended to identify how the issue has occurred and proof that this will not happen again, if you mention the employees "will need" to do this or that, it may not be sufficient. The employees should already be trained and processes set up to ensure success moving forward.

For clarity can you share the deactivation performance notification here, after removing your personal information, so we can review this fully?

I hope you have found this helpful and I look forward to your response. The Forums community and I are here to support you.

Wishing you the best,

LeviDylan
