Account suspension and Fund Hold

Hi everyone, I would really appreciate your advice on this matter. Our amazon accounts were suspended and amazon refused to release our fund of about £4,000 plus we have unsold inventory excess of £5,000 which costs so much money to remove from the Amazon warehouse.

I have been selling on Amazon since 2018, on the 9th of April 2021, we wrongly listed a similar brand (Streetwize) on a trademarked brand (MSA) listing on Amazon, and by doing so, we violated their Intellectual Property Rights and Amazon Policy. Based on the products’ physical attributes, at the time of listing, we mistakenly judged that the sourced product from the wholesaler was identical to the one shown on the Amazon listing for ASIN B077SKGD3H.

I have been trying to appeal the case with amazon ever since to no avail. Amazon is requesting a letter of authorization (LOA) or licensing agreement (LA) from the rights owner indicating that the products we are selling are authentic, even though I had to explain to the seller performance team on numerous occasions what has happened, that we mistakenly listed the products against another trademark listing in error.
I have submitted suppliers invoices, and show how the two products were similar in nature, and that
I did not and will never intend to infringe on any trademark nor sell counterfeit and commit any intellectual property violations.

I have reached out to the Rights Owner on numerous occasions, to have them retract the complaint of the Intellectual Property Infringement and resolve this matter amicably and to reassure them that the incident would not happen again and we take full responsibility for the error, however, they have not acknowledged our letters nor reply to any of my correspondence.

I have invested over £10,000 in the business, now my creditor, mainly family members want their money back, I wrote to Amazon in December 2021 to request for my money, and here is the reply I got from amazon yesterday 30.01.2022

“Hello TOMLA, After completing our investigation and reviewing the information you provided, we have determined that your Amazon seller account has been used to engage in deceptive, fraudulent, or illegal activity that harms our customers, other selling partners, and our store. What happens now? The funds in your account will not be disbursed to you. This is a final decision made after reviewing the information you provided. We may not respond to further emails about this issue. Where can I find more information about this policy? Bad as it sounds, it looks like you will have to take this matter to court and defend your case there.

By the response from Amazon they seem really convinced, that you have scammed their customers and they will not budge, so court it is for you.

Thanks for your advice, as I said, we listed a similar products against identical ASIN, it was a honest mistake, about 10 quantity of the items was sold, and it has all be refunded.
This is not fraudulent, I have sent in my id, including passport, proof of address, certificate of my company incorporation. I really hope amazon sort this out instead of going to court.
