Basically, to get the Cert you must be VAT Registered, you cannot be VAT registered unless you go over 100,000 Euro’s.

If you are not based in Germany the threshold is lower for you to register for vat is it not? Also if you store stock in germany through FBA you will need to be vat registered in germany.

Further complications will occur when UK leaves the EU in March. I assume then ,all will need to register irrespective of turnover.
Unless of course some sort of trade deal is agreed that specifically addresses this.

Yep, I’m under threshold so German law categorically states (as he has just said) that i do not need to register for it… yet Amazon persist. So frustrating

I didn’t watch the video, but again: Amazon is Amazon and they have their own rules which may be more restrictive than legally required. Basically, by requiring the certificate, they are covering their a##, which is probably clever. Do you really think you can talk Amazon out of it, so they are accepting a financial/fiscal risk?

I have contacted various Tax offices in Germany over this issue so far after my own UK based accountant advised me to do so.

Basically I outlined that I am VAT registered in the UK and well under the threshold in Germany. I sell across all the European marketplaces on Amazon, but stock is held and distributed from the UK via FBA, no stock is stores overseas.

Currently I have closed all German listings until this issue has been sorted out.

So far on basically stating all this to Steuerliches Info-Center , they replied

Dear Mr (NAME REMOVED),

When a foreign company sells goods in Germany, it must register for VAT.
_ _
Following tax authority is responsible for companies from the United Kingdom:

Finanzamt Hannover-Nord
Vahrenwalder Str.206
30165 Hannover

Fax: +49 (0)511 67 90 60 90

I questioned this for clarification as I sell goods TO Germany not within, because simply it does not sound accurate, however they responded saying they could not respond and I was to contact Finanzamt Hannover-Nord whom deals with the UK and Irish regions, I have heard nothing yet from this department, however I will respond back as soon as I do, however I imagine they are inundated with everyone right now.

The video certainly clarifies it for me. I checked if it is possible to upload the declaration document where Amazon expects the tax certificate and found that its not possible as they expect you to provide a VAT/GST number.

I guess the only option would be to attempt to email it to seller central support… Really hoping someone whom has sent it in can let us know of the outcome…

Not entirely accurate. We are under €100K but have German VAT registration and file German VAT returns monthly. You have to register for German VAT if you are over €100K but you can register if you are under.

Let’s not confuse what the law is and what Amazon require. They are in this case and in general very different things.

Basically, by requiring the certificate, they are covering their a##, which is probably clever. Do you really think you can talk Amazon out of it, so they are accepting a financial/fiscal risk?
