Getting lots of listings shut down for Trademark infringement
I sell a wide range of product, but mainly toys. Over the past few weeks I’ve seen an increasing number of these type of message:
Hello from Amazon selling partner support.
I understand that you are concerned about ASIN B00B9ZRZFS which has been removed from sale on Amazon however the item is a Fisher Price product and it does not misuse the trademark.
As per your issue, I would like to inform you that Fisher Price is a protected brand on Amazon and in order to sell this ASIN on Amazon, you can do one of the following.
• If you believe your listing is an authentic “Fisher-Price”, update the ASIN’s brand name to “Fisher-Price”.
• Remove the “Fisher-Price” trademark from the ASIN’s detail page (title, product description, and/or bullet points).
• If the ASIN is compatible with “Fisher-Price” products, you can update the ASIN detail page to use legally appropriate terms to clarify that the product is compatible with “Fisher-Price”.Further if you believe you have proofs and authorization to sell "Fisher-Price" products under your brand name, kindly provide us the authorization letter from the brand owner so that we can forward the same to our internal team for further reinstatement of these ASINs.
Anyone else seeing these types of message?
I’ve purchased these and all the other affected items via registered UK distributors, but SS won’t accept an invoice as proof of permission to sell.
I can’t contact the manufacturer directly since I’m not their customer; anyone any idea how to deal with these?

I had the same issue a couple of weeks ago with Funko products, purchased directly from Funko. I just edited the brand name in the listing to say ‘Funko’ and the listing was restored.
I don’t know why it didn’t already say Funko, I’m pretty sure it was already there.

These are Suspected Intellectual Property Rights Infringement Complaints and many sellers are experiencing issues with them, including me.
Appealing will not help, all you need to do is follow the instructions mentioned by Amazon:
If you believe your listing is an authentic “Fisher-Price”, update the ASIN’s brand name to “Fisher-Price”.
• Remove the “Fisher-Price” trademark from the ASIN’s detail page (title, product description, and/or bullet points).
• If the ASIN is compatible with “Fisher-Price” products, you can update the ASIN detail page to use legally appropriate terms to clarify that the product is compatible with “Fisher-Price”.
Once you do so, the listings will get reactivated on their own and defects removed.

We’ve started to get these for asin merged items now. Where Amazon or another seller has merged the asins, the data is now all mixed up, so can’t edit it as Amazon think the brand is X when it’s in fact Y etc etc.

BE WARNED!!! I had a few of these “POTENTIAL Trademark Infringements” Potential!. and now my Seller account has been suspended because of Potential trademark Infringements, No complaints from these ‘potentially’ infringing trademark owners just Amazon plucking names out the cloud.

We have just had a rival seller submit false trademark infringements. Its been a nightmare. Listings still blocked even tho amazon notice have ;‘Reinstated them’, they just reply with generic replies and have no interest in punishing the fraud that took place. The more and more I deal with amazon the more I want to sell my stuff elsewhere.

I’ve found it impossible to get some listings to show the correct details. It seems if another seller has entered their shop name as the ‘brand’ and themselves as ‘brand owner’, Seller Support won’t change the ASIN to the correct brand, even if I send them proof of the exact same EAN on the manufacturer’s website and original product packaging. I can’t even create new listings for the affected products, because as soon as you enter the EAN, you’re directed back to the other listing. I’ve been round in circles with SS insisting that only the brand owner can make changes and that I should create a new listing

I now have a total of 6 Suspected Intellectual property infringements on my account. All relate to branded items that I have not sold for 10 years, all were purchased from the manufacturer and I was an authorised distributor. I emailed SS who said ‘don’t worry, only suspected doesn’t mean anything and your metrics are not measured’ Still feel very uncomfortable and annoyed. Maybe I need to delete all my old inventory rather than keeping them as closed
