How to get a Brand name!
Hi everyone.
1st. I know absolutely NOTHING about this sort of thing.
2nd. I am a registered business.
I want to sell a GENERIC item.
The problem i have is !!
There are thousands of sellers selling the exact same item.
But i just can’t find an asin for mine.
IE. although they are the same item (They 100% definately are the same)
All the sellers seem to have put a brand name on the asins.
This is understandable.That’s business.They are protecting and building their businesses.
Using their own packaging i’m presuming.
It seems that the only way i will be able too list.Is to get my own brand name.
The items are generic.There not special or better than anyone elses.
I don’t want to be one of those sellers who put a name on them and sell at high prices.As if they were something better just because my name is on them.
They are what they are.Standard generic items.
My question is.
How do you do this.
Where do i apply for a brand name.
Most importantly.How much does this name cost.

I openly admit i genuinely know NOTHING about this sort of thing and would accept all advice.
Even criticism if it helps me.Criticism is not nice.But sometimes it can actually point you away from making a stupid mistake or a bad judgement etc.

You don’t need a brand name here, most of those other sellers are likely to be breaking Amazon’s rules by creating multiple listings for the same product. Brand on the packaging is irrelevant, it has to be on the item itself, otherwise it’s the same product and therefore belongs on the same listing.
If the product has a barcode on it, you must list against that barcode, otherwise you can use an existing ASIN and list against that, alternatively you’ll need to purchase a barcode from GS1 (only GS1 barcodes are guaranteed to work) and then create a listing using that new barcode.
You could then potentially put in a merge request with Amazon to have them merge the other ASINs together since they’re the same product, this would merge the reviews and sales rank, but of course would also put all the other sellers on the same listing.

You do not require a brand name to sell your product . I understand you are saying it is a generic product but the manufacturer must have applied some sort of brand name to it .
If you cannot find a listing with the same brand name as yours , than you should be creating your own listing . You do not need to private label your product just because others have . You just cannot hop onto their listing but you can create a new listing without creating your own brand .

It’s all about the brand registry. In order to get your brand in Amazon’s registry you need to 1) have it registered as a trademark in the relevant marketplace and 2) be able to demonstrate that you have that trademark printed on the products (and not just on a sticker etc).
Basically, if you have your brand officially registered as a trademark then it’s quite simple to do, this is the hurdle for a lot of smaller sellers

As far as I was aware, to be Brand Registered, the Registered Trademark can either be 1) Physically on the item itself or 2) On the packaging, as a part of the packaging, i.e. printed boxes, NOT a label. We are going to be putting our application in soon, and will be using Branded packaging, as the products cannot physically be branded (salt items).

According to my experience, most sellers of generic items will simply list on all the identical product pages, unless the product is shown as supplied with branded packaging.
If you create your own product page of a generic item, you can also expect, that the other sellers will shortly add their offers on your ASIN. Also, Amazon occasionally merges the identical pages into 1 listing.

As Ken said earlier, although surely there is a degree of poetic license used by the OP who said “thousands”, I’d personally steer clear of this item if there are even 10 other sellers selling the same item. More than 10 other sellers would be more than plenty for alarm bells to ring. I guess it works for some people.
The chance of appearing on page 1 in search is fairly remote.

I’m quite certain that a brand name does not have to be trademarked, doing so will protect the name better but as long as the name you choose is not conflicting with a registered trademark of a business in the same business, you can call yourself product whatever you want.
Our Mighty Bright name and products are protected to a degree, nobody can make what we make and call it mighty bright for eg. but we do clash with Mighty Bright (USA) who make led lighting.
Re-branding a product is nothing new and not illegal, simply speak to a signmaker (like me !!) and get some stickers made with your branding and slap em on, do the same with the packaging and it’s yours… it’s done with TV’s, white goods, commercial machines and myriad cheap chinese electronic products…
As far as amazon is concerned, list your product under your own brand name, create your own isin / barcode and away you go! If amazon had a thing against that, then half the products on here would vanish overnight!
