IP Trademark Infringement Advice

Hi,

Can anyone advise how to proceed with the following appeal on this items B075QQ2DMP, B075QPNCM9 and a Trademark infringement claim.

We have a letter of authorisation and invoices for the past 2 years from the well known brand that is mentioned in the title.

We keep putting in appeals with our letter of authorisation and explanations but we are not getting anywhere, we just keep getting the message:

I have just put another appeal in, but I am expecting it to get rejected like the previous ones, but I don’t know why?

I have noticed the listing details have changed since googles last cached version in February for the ASIN, I assume this may be a move to try and make our appeal harder but dont know for sure.

We have sourced from the manufacturer in the title, have letter of authorisation and have official invoices, so what I am missing thats keeps it getting rejected.

Any suggestions would be welcomed?

Perspex seems to be the brand, and you bought from the manufacturer, have a letter of authorization from them allowing you to sell on Amazon?, and have official Invoices from them?
Then who put in the infringement notice?
You need to show Amazon that this is a frivolous complaint.
They have given you the email address?

If you do have all the necessary documentation but are still getting rejected then you have two options, send a legal notice to the complainant demanding that they retract their complaint, and providing your proof of legitimacy, or email the executive team at Amazon to try and escalate this with them

Thanks for the response, when you say “They have given you the email address?” do you mean Amazons email address?

If you’re having trouble with Amazon accepting your evidence contact the complainant as listed on the initial IP Infringement Notice and request they withdraw the claim. They’ll need to email notice-dispute from the email listed and include the complaint ID, ASINs and your seller ID.

Thanks for the replies.

So whatever appeal i put forward, will it get refused by Amazon even with our letter of authorisation from Perspex and official invoices for the last two years, simply because they have placed a trademark over an item that has an existing trademark on it.

If so, that is a great way to ringfence any already trademarked item on Amazon and claim IP on it.

Not sure it is legal, but it wont be good for the platform.

Yes, one of the ASIN appears to have gone. Not sure if Amazon removed it.

The way, I understand this particular problem is:

  1. If the material is Perspex brand, we have a letter of authorisation to stock and sell it from Perspex.
  2. If its not Perspex, then the RuudraScott maybe infringing Perspex rights by ‘passing off’ Perspex materials.

If it is Perspex sheet are RuudraScott also infringing Perspex rights by claiming IP over the existing Perspex IP?

This is not to mention the 3 other Amazon policy violations RuudraScott created on the listing.

Either way, is it classed as listing abuse by Amazon?

Unfortunatley, the last time we tried to report a listing violation, we got a warning under our performance notification straight afterwards and it was registered against us!!!

It was eventually removed on appeal, so we will not venture down that path again.

I got the feeling Amazon did not want to ‘know’ of the issue because it probably caused them more work.
