Sellers rebranding our ASINs

Hi,

We have brand registry for out brand, but there are several sellers who have somehow got hold of our products and they are selling them under their own brand name, creating a duplicate ASIN.

How should i report these to brand registry? Every time i report an IP violation they never uphold my complaint, saying the seller has the product registered to their brand, which is precisely the problem. I am going round in circles with BR & seller support. Is there a way to deal with this that is effective, without having to make test purchases?

If they are on a different ASIN, they are not piggybacking your ASINs so I don’t see the issue.

Are they selling the same product? Do you have exclusivity to those products?

Are they selling at a higher price then using you to dropship?

They are selling an identical product under a new ASIN with their own brand name. I have no problem people selling the item under the correct ASIN. We hold brand registry for these products (when correctly branded by the seller). We work very closely with the manufacturer and have exclusivity for selling on Amazon alongside a select few other sellers.

I think it’s a big problem, I am not brand registered but there are so many products, that I should be allowed to sell as I buy them from the official brand owner, that have been hijacked by fake brands and therefore Amazon doesn’t allow me to sell them or ask me to provide receipts that I have bought them from the brand owner to be approved to sell them. As I buy them from the real brand owner and not the fake one, I can’t provide the receipts anyway. SS always insist the fake brand is the actual brand owner. The fake brands are not registered in the UK anyway and I don’t understand why Amazon keep protecting them,

From what you’re saying, you have found other sellers who you deem to be violating your intellectual property rights.

If your protected IP is being violated, then the next step would be clear.

For example;

lets say you bought a white plate from a manufacturer and had them emboss your brand on it:

If the other seller is selling the same white plate, but either unbranded or with their brand etched on, you don’t really have a case.

BUT

If they are selling the white plate with YOUR brand etched on it, but have stated the brand is something different on the Amazon PDP, then you can report it.

Looking at your asins you have many licensed products therefore you must already have a good IP solicitor you use
Can they not simply send those sellers a cease and desist ?

If these sellers are buying from you then let them as you are getting your selling price.
If the manufacture is selling them then you need to take it up with them since these products got your name on it.
I dont know what you are expecting Amazon to do?

I understand your concern regarding the listings Hijackers, Unfortunately we have faced the same issue once, we believe you should reach out to brand registry and file a claim against the sellers who are running your business, for that you have to reach our Brand registry support and file an “Intellectual Property” Claim “Trade Mark Infringement” and then select the sellers you want to remove.
You will be good to go, we are sure that Brand registry support will help you in this matter!

I think it is simple. You make a test purchase as you were expecting a certain brand. You didn’t receive it and return the item, having taken photos of the order received etc… Then you raise an authenticity complaint with Amazon, which you hope they act upon and ask the other seller for invoices - which they won’t be able to produce as the product is yours and not their brand.

Of course it also depends how much effort you want to spend on this - how much of the stock do they realistically have to hand? It cannot be replenished, according to your claims so far, so maybe you just sit it out and at some point in time they will no longer have any product to sell?
