SELLERS LISTING BRANDED PRODUCTS AS GENERIC
Hello Amazon,
We have a major issue with a few sellers listing branded products as GENERIC. these sellers are using the branded product's GS1 registered UPC. We have created many cases trying to correct this only to get the same response "please create a new ASIN"
These sellers are in violation of Amazon policy along with copyright and trademark laws. They are preventing us and many other from listing a branded product, with the correct UPC. This has allowed these sellers to cheat and monopolize thousands of products.
below is just one of thousand examples:
https://www.amazon.com/dp/B0DWK1QJ43
https://www.amazon.com/dp/B0DZ6442BD
two sellers have listed the same BRANDED and TRADEMARKED product a GENERIC. one of them is using the BRANDED UPC preventing anyone else from listing the product the correct way per Amazon policy.
Why is Amazon allowing this?

Hello @Seller_UihBzs3zjgHbM,
Thanks for reaching out. I have reviewed both ASIN's and neither of them have a UPC code on them.
Regarding listing items that are branded goes against the Generics Policy. You can report these violations in the Report a Violation tool or on the detail page under the bullet points where it says "Report an issue with this product or seller" and then you can report that this is a branded product, list the brand and state that it's listed as generic.
If you would like me to check the UPC to see what it's linked to, please provide it and I will be happy to take a look. You can also contact Seller Support if you are getting an error and they can investigate this for you. Provide them with all the information you are trying to add, including the UPC and if you still need help after they investigate, please provide me with your case ID.
I hope this is helpful!
Michelle

We have seen lots of this and gave up dealing with amazon on the issue and just sell these items on ebay...

This seller does the exact same thing. Multiple IP violations, product page tampering, lists the same product multiple times, deliberately misspells the brand name in the title, and manipulates main product images so the listing is not flagged by Amazon AI.
Tried alerting this to Amazon, but they don't care. Had a rep tell me that unless it's reported by the brand or caught by AI, they don't care if it violates policy.

This is amazon and brand registry is mostly fake. amazon has told us to list our brands a generic. Why because amazon has a really bad catalog. Amazon has no correct policy for anything. we have listed copyrighted items with the copyright's owner giving us permission to do so because of fake branding allowed by amazon. We wish you the best in your catch 22.

Same thing happens with Yu-Gi-Oh! & Pokemon Cards
Here's a listing as an example: https://www.amazon.com/dp/B0DGP6FW72
Amazon doesn't care. Off to eBay or TCGPlayer they go.

STOP doing anything. Close all cases on this matter that you created
Do this NOW please, here me out.
On this issue you must be patient, Amazon is an expert on this issue
Takes time, sometimes up to a year, BUT no seller ever last long doing this on Amazon.
Let this be clear sellers, no one will ever last long doing this.
What your doing is showing desperation, when Amazon sells everything
More than enough for all of us and millions more sellers too.
Stop this now, and let Amazon do there job, they are the BEST at shutting down GENERIC listing
Again, on this issue you must be patient.
Amazon allows this because there are millions of listings, BUT when they get to it
The seller is gone for good, PERIOD
Just make sure YOU don't break Amazon policy and move on
Your looking revengeful, not a good look at all

- Go to the GS1 database and look up the UPC - it shows the brand it is registered to.
- Send the screenshot of this with the report a violation tool, and you can open a case up. Not being the brand owner it is harder to get this escalated, but it can be done.
- As a brand owner, I am having this happen on our UPCs as well and have had to spend time with support showing that there is a Generic listing happening on our registered brand's UPC. It is a fight to get them removed.
- You could also try contacting the brand representative that you received the Letter of Authorization from and let them know this is happening. Most companies have someone who handles Amazon for their business and they can escalate the issue on their side.
