Ongoing Issue with Counterfeit Sellers on Our Private Label Listings

We are a private label brand that has invested significantly in advertising, branding, and building our brand image. Unfortunately, we have had an ongoing issue with other sellers jumping onto our product listings and selling counterfeit or generic versions of our trademarked products.

We have filed numerous complaints with Amazon about violation of our intellectual property rights, but have only received generic responses stating action has been taken, while the violating sellers remain able to list on our product pages.

To verify the issue, we have conducted multiple test buys from these sellers, which have confirmed they are shipping products that are materially different from our authentic branded items - either missing key components, using our logos improperly, or being outright counterfeit generics.

While our trademark registration is still pending due to lengthy processing times, we are the legitimate brand owners of these products. The other sellers are clearly listing infringing items violating our rights.

Incredibly, one of the sellers we have repeatedly reported has retaliated by flagging our own legitimate brand listings, causing us to receive intellectual property violation notifications - even though we are the rightful brand owners.

We have already explored potential legal options, but do not want to pursue a lengthy legal process to have these sellers removed if there is a more straightforward solution through Amazon's internal policies and procedures.

Does anyone have advice on more effective steps we can take beyond repeatedly reporting these intellectual property violations? We have invested heavily into building our brand's reputation, only to have it undermined by these unscrupulous sellers. Any guidance on a resolution would be greatly appreciated.

Hello @Seller_NbWxIzfSY49F8,

My name is Dougal from the Community Manager Team and I would be happy to assist.

I was able to review the 3 complaint ID's that you submitted via the Brand Registry site. I reviewed the listings you provided and since there are 2 separate products in the listing and they are different brands, I want to ensure you have the proper permission and Letter of Authorization from the other brand to sell their product with yours. PLEASE do not provide any company specific or proprietary information in this forum, I can open a direct case as needed to discuss further. There are some other areas that caught my eye that I suggest you review as well. In the About this item section, your brand is listed, but the item form, flavor and roast level all relate to the other brands products and this can potentially be misleading to customers.

Please take some time to review the Intellectual Property Policy for Sellers help page, the Intellectual Property for Rights Owners help page, the Amazon Brand Name policy help page and the Letter of Authorization help page.

The Intellectual Property for Rights Owners help page section "Reporting Infringement," about 3/4 of the way down the page provides step by step instruction on reporting IP violations, what to include and what not to include.

Please let me know if you have any additional questions.
