Amazon stole our barcode!

We have a product with an EAN registered with GS1, it is several years old and has been selling without issue on Amazon for all that time.

A few weeks ago i was suddenly unable to send stock of this item into FBA, the case-pack template showed a warning that the EAN was in use elsewhere. Upon researching this, its an item sold by Amazon.

Needless to say, seller support told me to use the report abuse tool, and the response i got from them was to raise it with seller support. This has, in typical Amazon fashion, been going on for weeks with no one in Amazon wanting to take any responsibility and actually investigate this. Far easier for them to send me round in circles with no solution.

So my question is, has anyone else faced this issue and am i wasting my time trying to get any solution from within Amazon? Do we have any legal recourse for this misuse of our EAN?

My only similar case was with an EAN becoming invalid after it was used in another country. Seller support were no help and I used trial and error going through every Amazon until I found it. I think it was in Japan. There was then another performance to get it taken down and allow me to use it again. All told it took several months, pushing a year. I also recall getting pushed from department to department. Brand registry, if I remember right, were the most help.

Your best hope with this is if someone did something similar and it wasn't Amazon who took it.

Have you tried purchasing the item?

I'd have a look and see where it's coming from. It may not be Amazon doing anything wrong. There could be a vendor that has made a product with that EAN.

Obviously keep fighting it but, for your sanity, you might want to cut your losses and set up a new EAN for your product. Even if it is given back to you they may have messed up the algorithm for it and the reviews too.

It could be a GS1 error, as stated above, but they seem quite efficient to me and given the choice of them or Amazon to originate this kind of problem I know where I'd put my money.
