Customer wanting refund refuse to pay Import tax

Hello i am new to Amazon, but sold on ebay for years. ( Just stating )

I have sold an item FBM to spain. I shipped the item as normal attaching customs for the amount i have got paid my the customer. He has a bill for 37.99Euro for import tax into spain.

He has messaged me saying he is not happy i should have told him about import tax. Note that when i sell on other platform i do no tell the cusmotours either it down to the customer to know there own country import laws.

So he has demanded a refund to cover the import tax, which as far as i am aware it is nothing my issue and i am suprised when he bought them it was not stated own his side like on other platform saying you might have to pay import tax.

Please see meassge below what has come from amazon to me

Details: We contacted you again by Amazon.com customer service to confirm that when the customer made the payment for the order, the shipping costs were also included, so it was your mistake not to document the package well and That is why customs has made the additional charge of 37.60 euros, the client will be sending the invoice where the charge is shown, please help with the refund. Investigate the problem and contact the customer to reach an agreement”

I wonder if Amazon would ever consider introducing something like the eBay Global Shipping Program? It makes things so simple for the seller.

You need a carrier that does customs clearance as delivery duty paid. If there is a 20% duty on the goods your need to incorporate this within your pricing. I assume you completed a CN22 and the relevant HS Code and EORI number.

I had to query something with the EU because I found it confusing and they replied with the following

The new customs declaration for the release for free circulation of certain low value consignments will apply as of 1 July 2021 instead of 1 January. The reason is that the entry into application of the new VAT e-commerce rules was postponed by 6 months in a legal amendment last year, after having taken account of the delays caused by the COVID-19 pandemic in the necessary IT developments in Member States and at economic operators.

Nevertheless, the substance of these rules has not changed, the EUR 22 import VAT exemption will be removed as of July. Consequently, VAT will be levied for all goods imported from 3rd countries, including the UK, regardless of the value of the goods. In order to ensure the collection of VAT, imported goods will be subject to an electronic customs declaration as of that date. That customs declaration will need to be lodged by the EU importer or his/her representative upon importation in the EU. The content of that customs declaration is based on the data available on the CN23 form.

Therefore, as of July, Royal Mail will need to send parcels under cover of a CN23, so that the postal operator in the EU Member State of destination can comply with its legal obligations regarding the filing of an entry summary declaration and a customs declaration in respect of the goods.

I have been selling into the USA, Australia, Norway for many years, which should now be the same as selling into Europe. 1). we no longer charge VAT on items we sell. So you can reduce the selling price or pay the import tax for the customer.
In the past, as explained above we have always reduced the price to exclude the VAT thus the customer is free to pay their import charges and customers in these destinations are used to this.
Customers in the EU are not and they still expect an item to arrive for the price they paid.
We have stopped selling into Europe because even though we reduced the price of VAT, customers still refuse to pay import charges and items are coming back at out cost. We have spoken with both our courier and royal mail and both are bringing at new services shortly were the import tax can be paid alongside the cost of shipping, so the customer will have nothing to pay. We will adjust our prices accordingly and it will be like before. So until royal mail etc bring in these services we have stopped sending to the EU.
There has been alot of problems, but they all seem to be made by a lack of information and peoples expectations. As mentioned I have been sending items to Norway for a very long time and there should now be no difference me sending to France or Norway, but everyone, couriers included, now seem to no longer understand this and making a big deal from this, and no idea why.

Do not confuse these 2 factors:

  1. Amazon rules state the seller must pay all duties and taxes, not the buyer. Yes, it is a little vague if this also applies to sales on UK to an address in the EU.

  2. You do not have to pay teh duties and taxes for sales via eBay, your website etc, the above issue only relates to Amazon.

The odd thing is that I have shipped over 100 orders last month that were over 22 euros from the UK to France and not a single customer has informed us of custom charges. We are vat registered, have an EORI number, and use RoyalMail International tracked. Can someone shed some light on this?

I see your point. I thought you could set different rates across the UK but I was wrong. The only thing you can vary is the Transit Time.

On Amazon seller need to pay all taxes and duties for other countries, customer dont have to pay anything, they will just pay for the product and then will receive. Thats what Amazon told to all sellers.

I had a similar situation straight after Brexit , before I realized the rules and when Amazin were till deduct the taxes at payment .
I explained it is all confusing to everyone , but they did not take the takes

And I would be more than happy to pay the charges over and above the taxes that were not taken at payment

And buyer very happy
