GPSR - Multiple Retailers on Same Listing/ ASIN

I just want to check I am not misunderstanding the new GPSR.

I know we can appoint our own GPSR person (companies are already sending random emails, a bit like the overseas VAT ones),.... if we sold our own items, on our own listing this would be fine.

BUT..

We sell branded items, where there will be several retailers on the same listing (as the manufacturer provides the EAN). - So, I am thinking, that this NEEDS to be the manufacturers who provide this information that we can upload on the listing?

(I have asked several of our manufacturers, and they are all thinking it was nothing to do with them)

My reasoning is that If I appoint someone, and add this to the listing, BUT company XYZ has the customer complaint, then they could look at the listing ASIN, contact my Responsible person about an item I never sold them?

OR, will Amazon allow EACH retailers to upload their information on the same ASIN, so there could be 10 different Responsible people depending on which retailer they bought it from?

Or, am I just being completely thick and looking at this the wrong way.

From a legal point of view, the EU expect all manufacturers to either be, or appoint a Responsible Person.

If they are in the EU or NI, then that should be a given. If outside the EU, then the first Importer would in theory be the Responsible Person. But there could be multiple importers of course.

Though you clearly raise a valid issue and amazon haven't clarified this yet....

If you are selling branding goods destined to the EU, then the importer will need to be clearly stated on packaging.

If the manufacturer does not have an entity in EU, or does not employ a EU Rep, then the importer becomes the responsible person. They should be confirming all declarations are correct and if unable to do so, not import the goods.

So to answer your question, the responsible person should match what is on the packaging. If there is nothing, then its likely/possible the product is not fit for EU regulations.

1. Kids Licensed Pyjamas. GS1 EAN is the Manufacturers (as it is produced under licence), several of us all sell the same item. (UK Manufacturer,)

Therefore retailers cannot appoint their own Responsible person (from my understanding), as only one will go on the ASIN details.

There may be 8 different retailers on this listing. So if the manufacturer does not want to employ a Responsible person for EU listings, then the items all get removed from sale in EU.

That I understand (ours, Amazon and manufacturers loss).... BUT then this leads to another question - what happens with Northern Ireland?. Which are sold on the Amazon UK site? - Can we simply exclude Northern Ireland from the shipping settings and that is fine - or will amazon have a hissy fit and pull the listings from the UK site as well?

2. Think of listings not created by your own company, but selling the same item, (lets take a branded game like monopoly for example), - we know that sometimes you cannot alter the listing (as you did not create it), but you are all selling the same thing from authorized distributor.

Does this mean that because you cannot amend / alter this listing to update it, (as someone else controls the listing), that Amazon will remove you from it, or delete the ASIN as no-one updates it?

On ebay/ your own website, you can control what is on your listing details, but Amazon, where everyone sits together is different/

I've yet to find any of our brand partners who know anything about GPSR, which is a concern as they all deal with the EU...

In regard to GPSR, for listings on our UK-based store, you don’t need to submit any information to Amazon. You must, however, submit the required information for listings on our EU-based stores. For instructions, open this help page in the Seller Central website for the EU-based store, where you sell products in scope of the GPSR.
