Unauthorized / fraudelulent seller on Class II medical Device listings - reported violation but no response after multiple cases and multiple days and weeks now.

I am looking for some help on this issue. Here is the scenario We are a licensed seller of class II medical devices with proper MDL and MDEL on all of our listings. In December our Manufacturer sent us a shipment via UPS and the shipment was "lost". ( case is open with UPS but you know how this goes). fast forward to April when the missing devices show up on our listing by another seller. (confirmed by purchasing and tracking the serial number to the missing box). They are essentially selling stolen goods.

I have tried reporting the seller to Amazon, through brand registry and the manufacturer has tried reporting as well. No response. We have reported through the report tool as well. The issue I am having is what is the standard policy> We have to go through hoops, prove our MDEL and a purchase order from the manufacturer to get these products listed, and then a reseller can just jump on and start selling? They have no access to the manufacturer for warranty and they do not have and MDEL (they sell books and a few plumbing supplies) This will adversely effect our ratings for sure. This product is also sold on VC so it is directly affecting the Amazon business as well as the reseller keeps trying to win the buy box and driving the price down. Please anyone @Daryl_Amazoncan you please help? We follow all the rules and then it is so disheartening when a seller can do this to another persons business. Plus they are violating Health Canada rules.

For this, it is better for you to keep all communication professional and focus on the regulatory/legal aspects rather than competitive concerns. My advice for you will be to submit through Brand Registry using "Report a Violation" tool, specifically citing:

  • Unauthorized sale of regulated medical devices
  • Sale of stolen property
  • Health Canada regulatory violations

On investigation provide if possible all Legal documentation such as:

  • Compile your MDEL licence
  • UPS lost shipment documentation
  • Serial number verification, showing the match
  • Purchase documentation from manufacturer
  • Health Canada regulations regarding Class II medical device sales requirements
  • Written statement from manufacturer confirming you as authorized seller

Continue to document all pricing changes and buy box manipulation as evidence. This type of situation typically requires persistent escalation through multiple channels before resolution is achieved.
