What Happens If My Trademark Application Is Rejected?

Hello fellow sellers & Amazon,

I’m currently selling on Amazon with my brand enrolled in Brand Registry. If my trademark application is rejected, I’m wondering what will happen to my brand on Amazon.

Does anyone know:

  • Will my brand be removed from Brand Registry if the application is rejected?
  • If my brand is removed from my current listings, can I register a new brand for the same listings?
  • Will this affect my ability to sell under the brand name or impact my existing listings in any way?

I’d really appreciate any insights or experiences from others who have been in a similar situation. Thanks!

Based on the "Manage your Brands" help page (https://sellercentral.amazon.com/help/hub/reference/GF79K5R2ZLCWCPJT):

If your trademark application is rejected, you may be able to apply for Brand Name Approval, which would allow you to:

  • Continue listing products under your brand name
  • Create new listings with the brand
  • Keep your existing listings

However, you would lose Brand Registry benefits (Enhanced brand protection, A+ Content, Brand Store, etc.).

Note that the success of your Brand Name Approval application may depend on the reasons for your trademark rejection.

Regarding transitioning existing listings to a new brand: If both your trademark and Brand Name Approval applications were rejected, this likely indicates significant issues with the brand name. While you created the original listings, a rejected brand name would mean you've lost the rights to use it. In this case, transitioning to a new brand would likely require new packaging and product modifications (if the current brand is permanently attached to the product). Given these circumstances, Amazon may not permit transferring the listings to a new brand.

Hopefully your trademark application will be approved and you won't need to explore these alternatives.

Yes. Your brand will, eventually, be removed from Brand Registry.

Your brand will not be removed from current listings. They stay as is. If you have A+ content, it also stays on there.

It will not affect your ability to sell under the brand name at all.

Your existing listings will not be impacted as long as nothing on your listing changes. Losing brand registry means your contribution level is worse now. If a hijacker appears and changes your title to "Bananas", you will have a hard time changing it back now. But you should still have the highest contribution levels for that listing because you are the creator of the listing.

However, you will not be able to create new listings using that brand name. You will have to apply to use that brand name...which is easy. Its the same thing as applying for brand registry. Send the live pictures and get permission to make new listings with that brand name.

You will lose access to A+ content with new listings as well as not being able to use the vine program.
