Just started FBM, 104 items shipped late, it's now resolved - do I have any chance to avoid listing suspension?
We've been selling on Amazon through FBA for 7+ years, we generally have 700k-$1M in annual sales. We recently decided to list some items as FBM and use a third party partner for storing and shipping those FBM products. They are a reputable company with 500 employees. We went live with our FBM offers on May 23rd in the evening. Unfortunately, despite confirmation from our partner that everything was set to go, there was an issue with integrating their system with Amazon.
All orders from May 23rd to May 27th could not be fulfilled in time, and only were shipped this morning. The integration issue was resolved, and all new orders since the 28th are packed and shipped within 2-3 business hours. For any late orders where customers requested 2 day shipping, I refunded the order in full even though we still shipped the order out.
Unfortunately, this morning when I logged into Amazon, I saw a banner that said "My account is at risk of deactivation". Upon clicking the actual banner, it clarified that it's actually my seller fulfilled listings that are at risk of deactivation. It is just a banner, and there is no option to provide to appeal or provide an action plan. The 104 late orders are all from May 23 to May 27, since then I had 37 new orders these were all shipped in time. My late shipment rate was as high as 75% but as slowly gone down to 73% as new orders come in and are fulfilled. All new orders have now been fulfilled within several business hours, and I don't foresee any new late orders.
I guess I am asking, how bad is it? At what point will Amazon ask for an action plan or will my listings be suspended before asking for a POA, given my high late shipping rate? Or can I avoid suspension entirely since there have not been any late shipments since May 28th and won't be moving forward, and my late shipment rate is dropping?

They may ban you from shipping FBM. Keep an eye out for the deactivation notice and have all your documented stuff ready.

Nothing much you can do. Provide them the information, your contract with that company and a statement from the company explaining why shipping was delayed and how they ensure it wont happen again.
In general, Amazon is not supportive of FBM shipping and will take it from you as fast as they can.

As a core FBM seller, it is normal to get those banners from time to time, as long as it is not a highly repeated occurance, it is very difficult to get banned through ODR, unless, it was repeated almost many times within a span of 60 days, then you are hit with Ban requesting POA.

Had a similar issue. There will be a mandatory training video that you will have to take. The appeal button comes with in 2 days after the banner. The problem that we had was the feature offer taken away on the asin. So document your evidence as much as you can and try to open cases on both seller support and account health support.

Look, stuff happens. Hopefully you've learned from the errors (not testing to ensure it worked) and it seems like you've fixed the problems. The warning banner will remain until you meet Amazon's expectations, but it will go away. Years from now, you'll laugh about it.
That said, you're going to need to avoid any late shipments for a few weeks to ensure your percentage gets below the threshold (which I think is 4% but I may be wrong). Just keep getting them out within 24 hours and the warning will eventually disappear.

Call Amazon, let them know you are aware of the issue and what plan you have in place to prevent it from happening again. Have them note it on the account. I wouldn’t mention the part about you drop shipping. That’s not allowed unless there an exemption of some sort I’m unaware of.
