My brand registry on Amazon have been rejected several times

Hello Amazon Community,

My brand registry on Amazon have been rejected several times, I’m sharing my case just to ask for help since now I’m desperate and have no clue what to do. Please help me finding a solution.

As ecommerce consultant I have been actively involved in creating brands and managing accounts for my clients for the past years, demonstrating a strong track record of success in handling multiple client accounts with utmost professionalism.

Upon transitioning from my office job to pursue my passion for selling on Amazon, I was surprised to receive a rejection from Amazon when it came to register my very own brand. Amazon stated several possible reasons that I want to analyze one by one.

A) Catalog Tampering Allegations:

I currently have only one product listed on my account, and I am not the original brand owner. The product was already present in the Amazon catalog, but it had inaccuracies in the brand name and material description.

Attempts to correct these inaccuracies have been met with challenges. Despite numerous efforts to rectify the mistakes, I have been unable to update the brand name and material information. For instance, the original listing incorrectly stated the material as plastic when, in fact, it is made of metal.

I have reached out to customer service multiple times, unfortunately, my requests for correction have not been granted and I have been unable to correct this mistakes directly from the seller account.

I am seeking clarification on whether my attempts to correct these inaccuracies are being misconstrued as catalog manipulation. I have no intention of violating any policies but rather aim to ensure accurate product information for both customers and Amazon.

B) your application or account is related to other Amazon accounts or brands that have violated Amazon or Brand Registry’s policies.

As an ecommerce manager, I responsibly manage multiple accounts for various clients. It is important to note that none of the accounts I oversee have encountered issues with Brand Registry or violated any Amazon policies.

It is crucial to note that all trademarks filed by my lawyer on behalf of my clients have been successfully approved, and we maintain strict adherence to both US federal regulations and USPTO rules.

Other considerations that in my option could been related.

Unethical Competition and Reputation Attacks:

I faced a fierce competition scenario involving a person from my city with questionable moral values. This individual made false claims to our supplier, attempting to hinder my ability to distribute a specific product. Fortunately, my supplier informed me of these actions and allowed me the opportunity to defend my business.

I provided evidence, including threatening emails from this competitor, which ultimately led to me retaining the distribution rights for the product. The unprofessional conduct and willingness to harm competitors' reputations were apparent, as this individual attempted similar actions against others in the same market.

It is conceivable that this competitor, known for employing unethical practices, may have impersonated disgruntled customers and contacted Amazon repeatedly, making false claims against my business. This has been a recurring pattern, as reported by others who have faced similar challenges from this individual. Their tactics involve leaving negative feedback, tarnishing reputations in front of suppliers, and even reaching out to Amazon to eliminate competition and secure the buy box repeatedly.

On one occasion, this competitor engaged in a deliberate attempt to deplete my inventory by making a massive purchase of my products through another account. Subsequently, they opened a claim with Amazon, seeking a refund and aiming to acquire my merchandise without legitimate payment.

Recognizing this as a recurring pattern, I reported the incident to Amazon on the second occurrence. Thankfully, on this occasion, Amazon did not process the refund, preventing the competitor from further exploiting these tactics. (Now I have to limit the purchases just to 1 unit per client, thanks to this individual)

Thank you for the details in this post. I looked into the most recent application case and several others to investigate the situation.

From the last 2 applications, it seems like the messaging is consistent and you were provided some reasons to why the application has been declined. Please note that to ensure abuse prevention processes remain secure, Brand registry (and myself) are not able to provide details.

However, what I can tell from experience helping many sellers here, typically sellers do not receive the "If you are enrolling with a US trademark, please note that the USPTO requires foreign domiciled applicants or registrants to be represented by a U.S. licensed attorney..." part of the message unless Amazon has detected that there was something wrong with the attorney or trademark.

There could be a high chance that this could be the issue preventing you from being approved.

If you’re concerned about the validity of your application or the conduct of involved parties, please consult with a private U.S. attorney to review your application.

Unfortunately, the address during that initial period is the same as my current address. I suspect this may be causing an unintended association with the account my sister had or has. I want to clarify that I have never used nor had any involvement with her Amazon account. This is my first and unique seller account.

I believe this additional context may shed light on the mentioned association issues and could be a contributing factor to the challenges I am currently facing with my Brand Registry application.

I have the packaging materials and the product itself that clearly display the branding, and I am also registered with the United States Patent and Trademark Office (USPTO) for the said brand.

To address this concern, I am more than willing to provide any additional evidence or information that may be required. Whether it's images of the packaging, the USPTO registration details, or any other documentation, please let me know what specific evidence is needed to support my application.

It is crucial to note that all trademarks filed by my lawyer on behalf of my clients have been successfully approved, and we maintain strict adherence to both US federal regulations and USPTO rules.

Other considerations that in my option could been related.

Unethical Competition and Reputation Attacks:

I faced a fierce competition scenario involving a person from my city with questionable moral values. This individual made false claims to our supplier, attempting to hinder my ability to distribute a specific product. Fortunately, my supplier informed me of these actions and allowed me the opportunity to defend my business.

I provided evidence, including threatening emails from this competitor, which ultimately led to me retaining the distribution rights for the product. The unprofessional conduct and willingness to harm competitors' reputations were apparent, as this individual attempted similar actions against others in the same market.

It is conceivable that this competitor, known for employing unethical practices, may have impersonated disgruntled customers and contacted Amazon repeatedly, making false claims against my business. This has been a recurring pattern, as reported by others who have faced similar challenges from this individual. Their tactics involve leaving negative feedback, tarnishing reputations in front of suppliers, and even reaching out to Amazon to eliminate competition and secure the buy box repeatedly.

On one occasion, this competitor engaged in a deliberate attempt to deplete my inventory by making a massive purchase of my products through another account. Subsequently, they opened a claim with Amazon, seeking a refund and aiming to acquire my merchandise without legitimate payment.

Recognizing this as a recurring pattern, I reported the incident to Amazon on the second occurrence. Thankfully, on this occasion, Amazon did not process the refund, preventing the competitor from further exploiting these tactics. (Now I have to limit the purchases just to 1 unit per client, thanks to this individual)

This is all, if somebody have more information about how to address this kind of situations please help me up.

From the last 2 applications, it seems like the messaging is consistent and you were provided some reasons to why the application has been declined. Please note that to ensure abuse prevention processes remain secure, Brand registry (and myself) are not able to provide details.

However, what I can tell from experience helping many sellers here, typically sellers do not receive the "If you are enrolling with a US trademark, please note that the USPTO requires foreign domiciled applicants or registrants to be represented by a U.S. licensed attorney..." part of the message unless Amazon has detected that there was something wrong with the attorney or trademark.

There could be a high chance that this could be the issue preventing you from being approved.
