FALSE IP Patent Violations (2) - We are licened and "lettered" seller. Please Tag Moderators
Best Glide ASE is a 20+ year business and a licensed seller of ASINs B01ITAKG6A and B0855JZ2MT for Combat Application Tourniquets (CAT) made by CAT Resources and distributed through their sole North American distributor, North American Rescue (NAR).
We received complaint ID 14781199371 that Amazon claims was submitted by The Counterfeit Report (TCR). However, TCR says they didn't submit it. NAR/CAT says they didn't submit it.
How can we violate a patent for selling the genuine patented product that we are licensed to sell?!?
Nevertheless, we submit our Contract, our Approval Letter from General Counsel, our invoices, correspondence denials from TCR, even a screenshot TCR sent us from their portal showing this complaint didn't come from TCR, and NAR/CAT. We request a phone call and get told that the complaint has been verified. Well, if TCR, NAR, and CAT didn't do it, then who was it verified with?!?
Anyway, TCR informs us that it is bigger than our 2 ASINs. Apparently, ours was 2 of 31 listings of FALSE IP complaints, supposed submitted by TCR, but they weren't. Yet, Amazon ignores everybody, including TCR, the supposed complaint filer, that didn't file the complaints.
Moderators, What do we need to do here for a real person with critical and/or cognitive reasoning capabilities at Amazon to actually address this matter?
Thank you

Seems to be some bots going wild.
We are in the same boat. Appeals and logic get automatically denied.

Hello @Seller_WYy0dOyHiTSMt
This is Web from Amazon. Thank you for reaching out with your concerns with your deactivated listings. I understand you have received patent complaints impacting couple of your offers, which you are legally licensed to sell.
Based on your post, I can infer that you have received a Right owners complaint stating that they believe you may be infringing on their patent.
Patent owners have the right to prevent others from making, using, and offering to sell the invention for a specific number of years. Additionally, Right owners can establish exclusive or selective agreements to award distribution rights for their products to specific parties.
In order to provide you with a more specific guidance please consider answering the following questions.
Is the patent rights owner the same owner of the brand of your product?
What is the type of patent violation in question?
Do you have valid rights and authorization from the rights owner to supply product using rights owners’ patent rights?
You should have received a performance notification with the appeal requirements.
Did you ensure you appeal included the requested documents stated on the performance notification received at the time the listing was deactivated?
There exist different appeal paths to address this type of violations. Please consider to share the Performance notification received to provide you with specific guidance on the next steps to reinstate your listings.
Additionally, refer to the patent help page to provide you with more information on our patent policy violations.
I have passed your concerns to Account Health team who will attempt to reach out by phone to further support on your specific situation.
Best Regards,

Try sending a streamlined (i.e. simple) email of what your problem is to jeff @ amazon . com (no spaces) this is the executive seller service people. They are very good about handling problems that regular seller service seems to not be able to solve.

You inferred wrong, dude.

It seems Amazon has a real problem with their automated enforcement tools. It is flagging too much and the appeal process is costing everyone time and money.

You actually put Distributor in the Forum. They only provide access to products. They have nothing to do with authorizing you to sell anywhere. You are responsible for getting approval to sell every product they sell to you.
