Selling in Poland Any answers

I have all my EU countries switched off at the moment because of confusing information about sending orders customs duty paid for the EU. One person tells me it is tariff-free and another tells me the exact opposite. So until I have answers that make sense I have it all switched off.

Everything I sell is Seller Fulfilled not FBA.

However, Amazon is pushing sellers to add products to the site in Poland, but I can’t get clear information about exporting to Poland. Would I need to be vat registered there when everything would be shipped from the UK? Would I need to pay customs duties on the deliveries and if so what is the rate?

How are sellers supposed to make sense of this when the information we actually need is not being provided by Amazon anywhere that I can find? All that seems to be available is vague generic sort of answers that as usual tell you nothing of value.

The information is freely available, if you can be bothered to look for it, and Amazon have made it clear what their policy is.

In essence, if you sell via Amazon.co.uk to someone resident in an EU country, you (the seller) must ensure that any import duties and/or import VAT that may be incurred by the end customer are paid, by you, up front. This is called Delivery Duty Paid (DDP). If you fail to do this, you will be in breach of Amazon’s policy and may have your account deactivated.

Therefore you must use a courier who offers a DDP service. Whether you’re registered for VAT anywhere is irrelevant.

As to whether a particular package will attract local customs import duties and/or import VAT, that depends on (a) the value and contents of the package and (b) the country to which it’s being sent. This information can be found on the EU’s official website and elsewhere. Note that certain categories of products attract duty while others don’t, and that duty is also linked to the country of origin (i.e. manufacture) of whatever it is you’re sending.

EU rules governing import VAT are due to change on 1 July 2021, so the above is only applicable until then.

Perhaps the more pressing problem is - why were many of us opened up to selling on Poland without our consent or prior warning?

I was just about to turn everything off for a hospital visit and noticed that all marketplace regions were off (like you I set all other than UK to inactive for the next few months) except PL. Which is suddenly back as active.

I’ve changed it inactive but as of right now (3 hours later) PL is still active.
UK has moved to inactive - which is toggled at the same time.

Perhaps PL is THE place to sell and were not taking their (not so) subtle hints.

I believe this is very simple
Amazon are offering seller fee discounts for Poland.

We have found that if the products are under 2 kilos and are less than 22 euro in value the customer gets the goods straight away and this has been successful where many other couriers have failed in last few months . This has also enabled us to drop prices in some cases as we do not have to send these duty paid

Please dont take my word for this , but we were advised by our tax accountants that we could send duty and taxes paid and deduct Amazon sales fees as this is not really a sale it is classed as an Amazon Mark up . we could also deduct any taxable amount when declaring customs valuations

This might be wrong advice and we are seeking clarification . but we have had it from 2 different sources now.

The quickest way to stop any sales to Poland is to put that country on Holiday settings as previously stated by other posters on this thread.
