Urgent: Amazon Inauthentic Violation Crushing a $30M Business – Appeal Rejected Twice!
Hello fellow sellers,
I’m facing an issue with an inauthentic product violation on one of our ASINs, and I’m hoping to get some advice or insights from the community. Here's the situation:
- We submitted an appeal with invoices along with a letter from the manufacturer confirming that we are an authorized seller and an email from the brand verifying our supplier as an authorized distributor.
- Despite providing these documents, our appeal was rejected by Seller Performance. As a result of these issue, we are gated for grocery products and unable to continue selling them on Amazon.
- Amazon also requested additional supply chain documents from our supplier. However, our supplier is only willing to release these documents directly to Amazon, not to us. Our Amazon Business Account Manager helped gather the necessary documents, and they were submitted under a Risk Mitigation Case.
- The appeal was rejected again, and we were instructed to submit it through Account Health. Unfortunately, the supplier has made it clear they will only provide the documents to Amazon.
Has anyone encountered a similar situation? Any advice on how to move forward or escalate this matter would be greatly appreciated. Thank you!

Hello @Seller_y96uow8gyhiOt,
Thank you for posting your concerns with your account and authenticity violation.
Since this was a concern with authenticity, I want to help clarify the origin of the situation. Was this a customer authenticity complaint, supply chain review, or concern of intellectual property misuse? Each of these scenarios can create concerns of authenticity and may require different documents to address them. Please share your original notification surrounding this concern so I can look further into your situation and offer any necessary guidance or next steps.

I cannot speak on behalf of any account manager, but there should be a path for them to submit the documents for review, regardless if they were provided through the account health page or not. Can you share any additional information such as a case ID where these documents were provided to your account manager? I may be able to review them further, offer guidance, or work with necessary teams to conduct any further reviews that may be required.

Something is not right.
You have the LOA from the manufacturer, you have the invoices from the supplier, but the supplier will not provide you the invoices from the manufacturer with hiddden prices?
But you already know where they are buying the products...unless they are not buying from where they claim they are buying. They may buy from auctions, closing sales etc.

Hello @Seller_y96uow8gyhiOt,
Thank you for following up with your information.
I have taken a look over the case and see this is associated to the ASIN ending in "Z138". I also see this particular case is due to a customer complaint surrounding not matching the description, rather than a concern of authenticity. This case additional shows no documentation provided, only screenshots of the product to confirm condition. Do you have another case with the relevant invoices or supply chain documents that are available?
I have also reached out to our review teams on the subject who did confirm there is an authenticity concern on this ASIN but no documents have been provided through the account health page for proper review. Are you able to verify what information has been provided, where it was provided or is available for this ASIN?

Something you can try with your supplier is give them user permissions to your account health and have them submit the information on their behalf. You will not be able to see the documents and you can show them that on previous appeals.

If you arent the brand, or the manufacturer, no way they can prove you are selling anything authentic
also, you didnt even say what the product is, or show us the listing, sounds like you are just buying from a wholesaler anyways.

Amazon knows what a commercial invoice includes. An invoice is used when Your USA business has a retail commercial credit account with the manufacturer. Most all invoices include all of the following:
- YOUR: business name, business address, business phone, sales tax exempt number, your EIN number, your credit line, and terms of sale
- MANUFACTURER’S: address, phone, EIN number, account Rep’s name & phone number
- PRODUCT’S: quantity, SKU-Model number,
- DISCOUNTS PROCESSES ON THIS PURHASE: quantity, sale, specials
- TERMS OF SHIPPING: method, who pays, company used, tracking number
- TERMS OF PAYMENT: 30 days, 60 days, 90 days, interest assessed
Some have more, but they all use the same basic format. Even when you call and make a small online order and pay by credit card, an invoice is still sent to you separately containing all of the above.
If you purchased the items from a distributor using cash and carry, or on-line with a credit card, and paid sales tax on it, you are not buying wholesale from the manufacturer.

Your problem can come from two different sources.
REAL REASON: From Manufacturer
It is quite simple; the owner of the products just wants to see if you actually have an account with the company and are approved to sell the product. Often this happens when the manufacturer does not know you by your Amazon user name, but knows you by your business account name with the manufacturer. Just submit the commercial invoices Amazon requests and it will be quickly cleared up.
FAKE REASON: From Competitor
The Intellectual Property reporting form is massively abused, and there is nothing you can do about it until Amazon changes the reporting process. Do yourself a favor. Under GET HELP, located at the lower portion of the seller central page, look up Report Intellectual Infringements. Open the report form. Read what it takes to fill out the form. Anybody can call themselves an Agent of the Company, give a bogus email address, and report you. That is all they have to do, now you have a problem. Reps seem to ignore this is the way it works and do nothing. The system is broken.
