Assistance Needed with Brand Registry Application Rejection

Hello all,

I am seeking your guidance regarding my recent Brand Registry application appeal, which was unfortunately rejected due to the reason: “could not verify the registered business name.”

I have ensured that the brand name entered in my application, Willow Boutique LLC, exactly matches the name listed in my trademark. Despite this, I’ve encountered the same issue with each submission.

Dougal from the Community Manager Team here and I will be happy to assist and thanks for the case ID.

That case ID is an appeal that is still being reviewed, but I noticed a few things that I think would result in another rejection. Please see the list below of what I recommend you review IF the current appeal is declined:

  1. The TM # listed on your application shows as a Service Mark for the Mark type, which is NOT an accepted mark type for Amazon Brand Registry. Only Design Marks and Word Marks are accepted and you can find this and further detail on the Enrollment guidelines for the US help page.
  2. The Mark of the TM on the application has no mark literal elements and the mark displayed is not exactly the same as the Mark name or the brand name you are requesting in your application.
  3. The images you submitted in your application all show a brand name that aligns with the "mark," on the TM in USPTO and not the Brand Name in your application
  4. The ASINs you included as Sample ASINs also do not match the brand name listed on the application. Everything has to match exactly as is in USPTO that includes having "LLC," in the application, but it is not on the TM or on the current ASINs. This one is an easy solve since sample ASINs are NOT a requirement for the Brand Registry application. You can find this in detail on the Amazon Brand Registry Application Guide, page 5, section 3.2.
  5. Since the application was originally rejected for 1 specific reason (you can review this by clicking on the red underlined "Rejected," on your Brand Applications dashboard, I recommend taking a look at the "Current Owner(s) Information," tab in your TM on the USPTO website. The information in that tab does not match what you submitted in your appeal on case ID 16982719651
