Catalytic Converter Restricted Products Policy Violation

Good morning @Cooper_Amazon,

I am writing to appeal the decision that five of my products Case ID (17811707101),Asin ending in(TXBP,R8LK,P5Z4,3TKL,CP5C)have been deemed in violation of Title II of the Clean Air Act. Currently, these products are unable to be sold, and my account health has been penalized with a points deduction. You have replied to me about the same issue before, so I think you can help me with this.

After a thorough review of the Clean Air Act regulations, I believe that my products do not violate any relevant policies. None of my products are designed to damage, attempt to damage, bypass, or disable emissions control systems. Specifically, my products are catalytic converters, which, according to the policy description, should be eligible for normal sale.

Thank you for your time and I look forward to your favorable response.

You can provide the relevant content to the reviewers. There are many catalytic converter-related products on the market that can be sold normally.

Moreover, these violations have deducted 16 points from my account health score, which is very hard for me to accept. Every time I appeal, the result is just a robotic email response.

Sincerely, JNXY_FortunaFlow

Good Afternoon @Seller_WQVSxwxjdgnoA!

It's Cooper again! I guess you are stuck with me. 😊 As I mentioned in our previous discussion, I have gone ahead and escalated the 5 ASINs you are hoping to appeal from CASE ID 17811707101 to one of our internal teams to review.

The partner team will review the information shared and make their decision, however I cannot guarantee it will change from the previous outcomes you have heard. With that understanding, I hope you have a great weekend and I look forward to sharing any updates I receive with you soon! Take care.

Sincerely, Cooper_Amazon

Good Evening @Seller_WQVSxwxjdgnoA,

I wanted to follow up with you as the partner team has rejected my escalation case since they do not have enough information to reinstate your ASINs at this time.

I would recommend creating a new Selling Partner Support for each ASIN and thoroughly share in detail with support why your ASIN does not violate the Title II of the Clean Air Act. At this time, the team requires more evidence detailing why you believe the enforcement was incorrect.

  • You can provide additional evidence that shows the specific nature of you catalytic converters to prove it does not violate the Title II of the Clean Air Act by including in your appeal manuals, schematics, photos, or a video recordings.
  • You should also work with your supplier, manufacture and compliance point of contact on your team to ensure the information being shared with Amazon and displayed to customers is accurate and not triggering the policy violation as well.

Please let me know if you have any questions regarding the information shared above or the outcome of this case. I hope you have a good night.

Sincerely, Cooper_Amazon

Good Evening @Seller_WQVSxwxjdgnoA,

I wanted to reach back out as I have gone ahead and reopened my case with the internal team I was working with previously and shared the new information you provided on both CASE ID 17811707101 and CASE ID 17818418091.

Once again, I cannot guarantee the team is going to overturn their decision to keep the 5 ASINs down, but we will see what they say. Please keep watching your open cases too. Have a good night.

Sincerely, Cooper_Amazon
