Need Help Dealing with Error 5461: Matching Brand Name

Hi all, first time Amazon Seller Here. I am currently trying to list my product to sell on Amazon, only to run into error 5461 (Matching Brand Name). Upon further research, I do see that there is another brand listed on amazon with the same name selling a different product. However, there seems to be no active trademark associated with the brand on USPTO - this is the reason I decided to go with the brand name in the first place. I have already committed resources to developing this product with the current name so any help in disputing this would be much appreciated.
