Scammer Seller used MY Brand Trademark Reg No To Register Similar Brand Name In order to Remove All Sellers Selling my Brand Except Themselves..

Serious Fraud Here: Someone selling my brand for which I am a registered agent for has registered a similar name using my trademark registration number and I cannot get Amazon to help. I found this out when we broke down and decided to register our brand with Amazon to finally get the false trademark reports to stop.

- I have tried calling, but their fraud line did not have a department for this so they couldn't transfer me anywhere.

- I tried reporting this several time through cases in seller central but this goes way over those agent's heads they do not understand.

Lets say my brand's name is GRASS. They registered the name gRass. Using MY trademark registration number. They are then using this to report trademark violations on all the listings of my authorized resellers to have them removed so they are the only ones standing and have no competition.

Even though my distributor's listings say GRASS, the product packaging say GRASS, etc, they tell support, they are not selling gRass, so, therefore, they do not have to abide by their "trademark" this goes over amazon's support agents heads, and their listings are removed.

I have in my possession the following pieces of evidence which I have submitted to Amazon support through Seller Central to no avail because I can't get the case into the hands of leadership who is equipped to understand reports of this magnitude.

1. My brand's trademark paperwork showing the real name, capitalization and registration number.

2. A letter from seller support to one of my authorized sellers stating MY real brand name is not registered with Amazon, only the fake name is registered.

3. A copy of MY attempted brand registry application with the real brand name showing our trademark registration number is already in use.

To all sellers, and forum Amazon employees, can anyone help? This scam to remove all competition cannot be allowed. This scam to prevent the real brand from registering cannot be allowed.

Are you registered with the USPTO?

Have you verified that YOUR TM is still active and the ownership and agent are still the same?

This is how amazon works. They help the bad actors and let the honest sellers figure out what to do. Amazon where the bad guys win.

Thank you for reaching out about this. I've taken a look into this and as you mentioned, this trademark is already registered in Brand Registry.

You said you are a registered agent for this brand so my recommendation is to reach out to the brand directly to see if they have registered the brand in the past. If not, the brand owner can dispute this from their end!

No one on this (or any forum) will resolve your problem (and that includes the worthless mods).

You need an attorney to send a cease and desist letter to Amazon corporate legal and be prepared to sue the offender naming Amazon as a co-conspirator.

Amazon my try to stand behind the "mandatory" arbitration clause but arbitration cannot resolve trademark, patent, copyright or any intellectual property cases.

You have the original paperwork for your trademark I assume? Contact USPTO. They will tell you what to do.

As a final step in the Brand Registration process, Amazon reaches out to the administrative contact named on your trademark application, usually your trademark lawyer, and provides them a secret code.

Amazon then tells the Brand Registry applicant to retrieve that secret code and message them back with it.

Assuming you still have a valid trademark, some combination of social engineering and professional administrative errors went into the situation you are currently experiencing.

I would waste no time, check in on the status of your trademark and ask lots of questions.
