Hijacker attempt

Hi,

I have been selling my own branded product for 4 months or so. I checked my trademark number earlier as I hadn't added it to brand registry, I have noticed someone else has put the same brand name but in a slightly different class (but similar) the application has been accepted, but still needs to be registered. I was wondering if someone had any advice on what to do?

What do you mean by "the application has been accepted, but still needs to be registered"? Did you decide to apply for Brand Registry?

You need to contact your IPO office, not Amazon. The IPO office will help and advise you. You have a limited window to raise this with the IPO office. If you already have a TM registered you should have paperwork and a phone number to call.

At this stage you still have your say. It is surprising that IPO have not been in touch with you with regards to that application as long as they as similar. What you need to do now is oppose and submit your case if you disagree.
