Someone selling under my listing

So I am new to Amazon and I have a private label product that I launched a year ago but due to personal problems I didn't start PPC campaign on it until recently

Since starting PPC I have started getting sales even though not enough to offset costs

Sales have reduced recently and came to an end abruptly 4 days ago

Looking at my listing closely I realised it states " sold ans dispatched by" a different company even though the brand is still mine

Also the listing is shows 2 items in stocks while I have way more stock left in my inventory 2

This product is sold at a price less than what I normally sell for and it says Vat invoice download able within 24hours of sale even though I am not Vat registered

I have contacted Amazon several times to bring to their attention but they came back to me to say the following :

"Please know that buy-box eligibility is based on a variety of factors that can affect the customer experience.

Also, winning the buy box doesn't guarantee that your offer will remain a featured offer all the time. If the system finds another selling partner with better metrics, it will select the best selling partner according to the system in place.

Here are some tips that can help you drive sales without the buy box:

- Use high resolution images with clear detail.

- Include key features with benefits listed in your bullet points.

- Make sure that your product is classified in the right category for easier discovery via browsing.

- Research the competition as you develop a compelling price point.

- Follow up each order with great customer service.

- Offer free shipping, which can encourage buyers come back to Amazon.

Selling Partner Support will not be able to provide any further information."

I don't know what to do regarding this situation as someone is clearly selling their product under my brand and listing and Amazon can't see it from their end

Please advise! I 'm I reading this incorrectly?

first of all, Amazon is a catalogue system so it isn’t your listing. In theory, anyone who has that product can sell under the listing.

Taht being said, if the listing was branded then it’s unlikely anyone else has said product, but are you brand registered?

And is the product actually branded with your brand physically?

I see product you are talking about is registered under your own brand name.

The other seller seems to be a new seller/low seller feedback and 2 units in stock FBM. Probably selling an Ali Baba doppleganger.

You can attempt to file an IP complaint to get them kicked off the listing. Search for Report Infringement in the seller central search box or google to file your complaint.

Hi @Seller_xb9bGdX9LhZl6,

Thank you for getting in touch.

If you're the owner of intellectual property rights and need to report potential infringements to Amazon, please utilize the appropriate public notice form if you're not registered in Brand Registry.

As explained by @Seller_ZJhFeE3tNKzfh, other sellers can list items for sale on pages you've created or added your copyrighted images to.

However, Amazon do expect sellers to list only against detail pages that precisely match their items.

As mentioned by @Seller_k2X0L9mVRT0pW, if you're not registered with Brand Registry, Amazon may remove the listing from the catalog after receiving your notification.

For more information, please refer to the Amazon Intellectual Property Policy.

Cheers, Ezra
