Unuathorized amazon sellers stealing my listings!!

My account is being attacked by unauthorized amazon sellers. As I am in the process of joining brand registry, and my trademarks are pending with the canadian government, my listings are being stolen by unauthorized amazon sellers. I am the sole manufacturer of my products, and the only authorized seller. They are stealing my products including the title, images, descriptions and hard earned reviews, and lowering their price to win the buy box. They put 1 item left in stock to trick my customers into buying the lower price. I keep putting through infringement claims but since my products are fully registered, I cannot sign up for amazon transparency and these sellers keep coming back every day stealing my listings. The only document I am able to put through to protect myself is the 'another seller is trying to harm my business' which works some of the time, but the sellers just come back with a new account to steal my listings. I am afraid my customers will buy the cheaper product, and I have no idea what these scammers are going to send my customer, that is if they send anything. If this happens it will reflect badly on my listings that I have worked so hard to build. I keep reaching out to amazon support but theres nothing anybody has been able to do to help me. Please let me know if anyone has advice as to how I can take care of this situation once and for all. It is extremely exhausting having to check my products constantly to see if they have been stolen, and start submitting every document I possibly can to have them removed temporarily, just for them to come back with a new account. You have to get your trademark approved, and then do test buys, and then if they are counterfeit, report them.

If you don't have an approved trademark, then there is no way to tell that they are counterfeit, because there is no trademark.

contact brand registry, if they can’t help, speak with a trademark lawyer. He will direct you in the right direction.

simpler questions is, are you manufacturing this in China? where others can do similar products with one small change?

Because if they are stealing your title, images, descriptions and hard earned review, are the products similar? Or where are they getting their products from?

if you have unique product that you are manufacturing in Canada, you should be able to control your brand.

We have brand registry for some of our manufactures, in Canada marketplace, there is no restrictions if someone else buys it from manufacture and lists and sells under our listings. We can submit IP and Trademark infringements, like other brands are doing it, or go even beyond and lie that products are counterfeit (which we know they are not)

Yes Transparency will solve this, however, it doesn't stop them from creating similar listings and doing proper ranking of their ASIN,to become top seller, if they are selling for cheaper.

One thing you have to remember, there are always people who, once they see good selling ASIN, they will jump on it and try to beat you up in the price.

Amazon has certain policies and procedures you have to follow to report counterfeit inventory. If you don't have an approved trademark, those rules do not apply through Amazon.

You would have to go after the seller outside of Amazon with legal action.

Canada trademark approval is taking 2-4 years. You can acquire screenshot photos of hijackers and submit to your attorney. They can speed up your application time with this evidence. Another solution is to get a trademark from Germany- you can get a registered trademark there in 10-14 days. Once you have your trademark apply for Transparency with Amazon. Once your products are enrolled into this program problem will be resolved

The advice I gave to the OP is correct. Amazon isn't going to do anything about it, until trademark is approved in full, and the seller isn't going to be able to go up against a behemoth like Amazon legally, so they have to pursue legal action against their competition outside Amazon.

To y‘all out there that are seeking true answers / advice about Trademark Infringements , seek your own legal advice outside of Amazon if Brand Registry can not help, a good trademark lawyer will help you.

You are quite literally quoting and saying what I already mentioned above. I already mentioned to the op that they will have to take legal action outside of Amazon to fix this, until they have a fully approved trademark.
