IP Complaint, Policy Warning

I'm hoping for a little advice as I was just hit with a policy violation and I don't want to appeal but I don't want an infraction on my seller account either.

I just honestly didn't know there was a patent on a particular product. Also, I haven't even received the product in stock to sell yet as it's still in transit. I plan things on intercepting the shipment and sending directly to me and eating the investment.

I just don't want to lose my account. Anyone else ever have this happen and what to do?

Patents are legal protections granted to inventors for their unique products, designs, or processes. While we understand this was unintentional, it's important to note that all sellers are responsible for ensuring their products don't infringe on intellectual property rights. This helps protect both inventors and our marketplace integrity.

We also understand your concern when you mention "I don't want to appeal but I don't want an infraction on my seller account." While we recognize this is a challenging situation, it's important you know that without an appeal, the violation will remain on your account record for 180 days. This is part of our standard process to maintain marketplace integrity.

If you do consider appealing, provide one of the following:

  • Invoices proving the authenticity of your products (you may remove pricing information); OR
  • Amazon order IDs demonstrating product authenticity; OR
  • An authorization letter from the rights owner (cannot be a forwarded email); OR
  • A court order finding that your product does not infringe the asserted IP, or that the asserted IP is invalid or unenforceable.

We truly value your proactive approach in addressing this situation and your commitment to maintaining a compliant seller account.

Best,
